Se’if 1א׳
דין המשכיר בית על תנאי. ובו ד סעיפים: שכירות קרקע נשכר בדרכים שהוא נקנה בהם (ואין אונאה לשכירות קרקע כמו במכירת קרקע (הרא"ש כלל א' סי' ז'):
The law of one who lets a house on condition; it contains four se'ifim. The hire of land is hired in the ways by which land is acquired (and there is no overreaching in the hire of land, as in the sale of land) (the Rosh, klal 1, siman 7).
Se’if 2ב׳
כשם שמתנה אדם כל תנאי שירצה במקח כך מתנה בשכירות וכל שממכרו ממכר בנכסיו שכירותו שכירות וכל שאין לו למכור אין לו להשכיר אלא אם כן יש לו פירות בלבד באותו קרקע שזה שוכר ואינו מוכר:
Just as a man stipulates any condition he wishes in a purchase, so he stipulates in hire; and anyone whose sale of his property is a sale — his letting is a letting; and whoever has nothing to sell has nothing to let, unless he has only the produce of that land, for this one lets and does not sell.
Se’if 3ג׳
השוכר בית מחבירו וטוען ששכרו על תנאי שיכניס עמו דיורין אחרים והמשכיר מכחישו ישבע המשכיר שלא התנה כן והוא הדין לכל טענות שביניהם (ועיין לעיל סי' שי"ב סעיף ט"ז ולקמן סי' שט"ז סעיף ב'):
One who rents a house from his fellow and claims that he rented it on condition that he might bring in other dwellers with him, and the landlord contradicts him — the landlord swears that he did not stipulate so; and the same is the law for all the claims between them (and see above, siman 312, se'if 16, and below, siman 316, se'if 2).
