המשכיר בית לחבירו בבירה גדולה באיזה מקום רשאי להשתמש. ובו ד סעיפים: המשכיר בית לחבירו בבירה גדולה משתמש בזיזים ובכותלים עד ארבע אמות ובתרבץ של חצר וברחבה שאחורי הבתים ומקום שנהגו להשתמש בעובי הכותלים ובכל אלו הדברים הולכים אחר מנהג המדינה והשמות הידועים להם:

One who lets a house to his fellow in a large building: in what place he may make use; it contains four se'ifim. One who lets a house to his fellow in a large building — he makes use of the projections and of the walls up to four cubits, and of the open area of the courtyard, and of the open space behind the houses, and of a place where they are accustomed to make use of the thickness of the walls; and in all these matters they follow the custom of the country and the names known to them.

Se’if 2ב׳

המשכיר חצרו סתם לא השכיר הרפת שבה:

One who lets his courtyard without specifying has not let the stable that is in it.

Se’if 3ג׳

הזבל שבחצר הרי הוא של שוכר לפיכך הוא מיטפל בו להוציאו ואם יש שם מנהג הולכים אחר המנהג בד"א כשהיו הבהמות שעשו הזבל של שוכר אבל אם הבהמות של אחרים הזבל של בעל החצר שחצירו של אדם קונה לו שלא מדעתו אע"פ שהיא שכורה ביד אחרים: הגה מיהו אם קלטו השוכר בכלי מן האויר ולא נח בחצר הרי שלו (טור ס"ו):

The dung in the courtyard belongs to the tenant; therefore he deals with it and removes it; and if there is a custom there, they follow the custom. In what case are these words said? When the animals that made the dung were the tenant's; but if the animals were others', the dung belongs to the owner of the courtyard, for a man's courtyard acquires for him without his knowledge, even though it is hired out in the hands of others. Hagah [Rema]: However, if the tenant caught it in a vessel from the air, and it did not come to rest in the courtyard, it is his (Tur, se'if 6).
