Se’if 1א׳

המשכיר בית לחבירו לזמן קצוב או סתם. ובו כ סעיפים: המשכיר לחבירו בית או חצר או מרחץ או חנות לזמן קצוב אינו יכול לחזור בו ולהוציאו תוך זמנו אפילו נפל ביתו של משכיר שאין לו מקום לדור בו ואפילו העני וצריך למכרו לאחר אינו יכול להוציאו והמקח קיים ולוקח צריך להניחו ביד השוכר עד שישלים זמנו ואם היה מושכר בענין שלא היה יכול לפדותו לעולם אם לא מכרו יכול למכרו ולהוציאו מיד (הרא"ש ומרדכי פ' השואל) התנה עמו שיוכל להוציאו לצרכו ומכרו אין הלוקח יכול להוציאו (ריב"ש סי' רכ"ז) ואם הקדים לו השכר אפי' לזמן מרובה אינו יכול להוציאו עד שיכלה זמן כל השכירות שהקדים לו: הגה ואפי' לא קצב לו זמן אפ"ה מסתמא שכרו נגד מעותיו (ב"י) המשכיר בית לחבירו ובתוך הזמן רוצה לבנותו אין יכול לכופו לצאת אפי' לבית יפה ממנו גם להכניס פועלים לבית לבנותו מיהו מבקשים מן השוכר לעשות לפנים משורת הדין (מרדכי רב"ב):

One who lets a house to his fellow for a fixed time or without specifying; it contains twenty se'ifim. One who lets to his fellow a house, or a courtyard, or a bathhouse, or a shop, for a fixed time cannot retract and put him out within his time — even if the landlord's own house fell and he has no place to live in; and even if he became poor and must sell it to another, he cannot put him out, and the sale stands, and the buyer must leave it in the tenant's hand until he completes his time. And if it was let in such a case that he could never redeem it unless he sold it, he can sell it and put him out at once (the Rosh and Mordechai, chapter "One who borrows"). If he stipulated with him that he could put him out for his own need, and then sold it, the buyer cannot put him out (Rivash, siman 227). And if he paid him the rent in advance, even for a long time, he cannot put him out until the time of all the rental that he paid him in advance has ended. Hagah [Rema]: And even if he did not fix a time for him, even so, presumably he rented it against his money (Beit Yosef). One who lets a house to his fellow and within the time wishes to rebuild it cannot compel him to leave, even for a finer house than it, nor to bring workers into the house to build it; however, they ask the tenant to act beyond the strict line of the law (Mordechai, the beginning of Bava Batra).

Se’if 2ב׳

אם חזר אחר שהשכירו לזה והשכירו או מכרו לעכו"ם או אנס שהפקיע שכירות הראשון ה"ז חייב להשכיר לו בית אחר כמותו וכן כל כיוצא בזה:

If, after he had let it to this one, he went back and let it or sold it to a gentile or to a violent man, who took away the first one's tenancy, he is obliged to let him another house like it; and likewise in every case like this.

משכנו לשנים ידועים בכך וכך לכל שנה ושנה כ"ז שלא יפדנו וחזר ומכרו לאחר אין הלוקח יכול לקחתו מיד המלוה תוך השנה אבל אחר השנה יכול לקחתו:

If he pledged it for known years, at such-and-such for each and every year, for as long as he does not redeem it, and then sold it to another, the buyer cannot take it from the lender's hand within the year; but after the year he can take it.
