Se’if 1א׳
השוכר את הספינה ופרקה בחצי הדרך או טבעה בחצי הדרך. ובו ו סעיפים: ספינה שהוסיף בה א' משלשים על משאה וטבעה חייב לשלם דמיה:
One who hires the ship and unloaded it halfway along the road, or it sank halfway along the road; it contains six se'ifim. A ship to whose load one added one part in thirty, and it sank — he is liable to pay its value.
Se’if 2ב׳
השוכר את הספינה וטבעה בחצי הדרך אם א"ל ספינה זו אני משכיר לך ושכרה השוכר להוליך בה יין סתם אע"פ שנתן לו השכר יחזיר כל השכר שהרי זה אומר לו הבא לי הספינה עצמה ששכרתי שהקפדה גדולה יש בספינה זו ואני אביא יין מכל מקום ואוליך בה: הגה ואם אפשר להוציא הספינה מן המים ולהשכיר ספינה אחרת בדמיו או בכל מה ששייך לספינה צריך להשכיר כמו שנתבאר לעיל סי' ש"י לענין חמור (הגהות מיימוני פ"ה דשכירות):
One who hires the ship, and it sank halfway along the road: if he said to him, "This ship I am hiring out to you", and the hirer hired it to carry wine in it without specifying, then even though he has given him the hire, he returns all the hire; for this one says to him, "Bring me the very ship that I hired, for I am greatly particular about this ship, and I will bring wine from anywhere and carry it in it". Hagah [Rema]: And if it is possible to take the ship out of the water and to hire another ship with its value, or with all that belongs to the ship, he must hire one, as was explained above, siman 310, regarding a donkey (Hagahot Maimoni, chapter 5 of the Laws of Hire).

א"ל ספינה סתם אני משכיר לך ושכרה השוכר להוליך בה יין זה אע"פ שלא נתן לו מהשכר כלום חייב ליתן כל השכר שהרי אומר לו הבא לי היין עצמו ואני אביא לך ספינה מ"מ ואוליכנו אבל צריך לנכות כדי הטורח של חצי הדרך שאינו דומה המטפל בהולכת הספינה ליושב ובטל (ויש אומרים דאינו נותן לו אלא שכירות מחצי הדרך) (טור בשם הרא"ש):
If he said to him, "I am hiring out to you a ship" without specifying, and the hirer hired it to carry this wine in it, then even though he has given him none of the hire, he is obliged to give all the hire; for he says to him, "Bring me the very wine, and I will bring you a ship from anywhere and carry it". But he must deduct the equivalent of the trouble of half the road, for one who is occupied with bringing the ship along is not like one who sits idle (and some say that he gives him only the hire for half the road) (Tur in the name of the Rosh).
