Se’if 1א׳
השוכר את החמור ונסתמא או מת או נשבר. ובו ג סעיפים: השוכר את הבהמה וחלתה (ועדיין ראויה למלאכה) (טור) או נשתטית או נלקחה לעבודת המלך אע"פ שאין סופה לחזור אם נלקחה דרך הליכה הרי המשכיר אומר לשוכר הרי שלך לפניך ונותן לו שכרו משלם בד"א כששכרה לשאת עליה משאוי שאפשר להשליכה בלא הקפדה אבל אם שכרה לרכוב עליה או לשאת עליה כלי זכוכית וכיוצא בהם חייב להעמיד לו בהמה אחרת ואם לא העמיד יחזיר השכר ויחשוב עמו על שכר כמה שהלך בה מתה הבהמה או נשברה בין ששכרה לשאת בין ששכרה לרכוב אם אמר לו חמור סתם אני משכיר לך חייב להעמיד לו בהמה אחרת ואם לא העמיד יש לשוכר למכור הבהמה וליקח בה בהמה אחרת ואם אין בדמים ליקח בהמה אחרת שוכר בדמים בהמה אחרת עד שיגיע למקום שפסק עמו:
One who hires the donkey, and it went blind, or died, or was broken; it contains three se'ifim. One who hires the animal, and it fell sick (and is still fit for work) (Tur), or went mad, or was taken for the king's service — even though it is not likely to return — if it was taken in the course of the journey, the one who hired it out says to the hirer, "Here is yours before you", and he pays him his hire in full. In what case are these words said? Where he hired it to carry on it a load that can be thrown on any animal without particularity; but if he hired it to ride on it, or to carry glass vessels and the like on it, he is obliged to provide him another animal; and if he did not provide one, he returns the hire and reckons with him the hire for as far as he went with it. If the animal died or was broken, whether he hired it to carry or hired it to ride: if he said to him, "I am hiring out to you a donkey" without specifying, he is obliged to provide him another animal; and if he did not provide one, the hirer may sell the animal and buy another animal with it; and if its value does not suffice to buy another animal, he hires another animal with the value until he reaches the place he settled with him.
Se’if 2ב׳
א"ל חמור זה אני שוכר לך אם שכרה לרכוב עליה או לכלי זכוכית ומתה בחצי הדרך אם יש בדמיה ליקח בהמה אחרת יקח ואם אין בדמיה ליקח שוכר אפי' בדמי כולה עד שיגיעו למקום שפסק עמו ואם אין בדמיה לא ליקח ולא לשכור נותן לו שכרו של חצי הדרך ואין לו עליו אלא תרעומת ואם שכרה למשא הואיל וא"ל חמור זה ומת בחצי הדרך אינו חייב להעמיד לו אחרת אלא נותן לו שכרו של חצי הדרך ומניח לו נבלתו: הגה ויש חולקין וס"ל דאפי' שכרו למשא דינו כשכרו לרכיבה (טור) בשם הראב"ד) והא דאמרינן דנותן לו שכרו מחצי הדרך היינו שיכול למכור סחורתו שם או שיכול לשכור חמור אחר עד מקום שרוצה לילך אבל בלא"ה אינו נותן לו כלום משכרו דהא לא מהני ליה מידי (טור):
If he said to him, "This donkey I am hiring out to you": if he hired it to ride on it or for glass vessels, and it died halfway along the road, then if there is enough in its value to buy another animal, he buys one; and if there is not enough in its value to buy, he hires, even with the value of the whole of it, until they reach the place he settled with him; and if there is not enough in its value either to buy or to hire, he gives him his hire for half the road, and he has against him only a grievance. And if he hired it for a load, since he said to him "this donkey", and it died halfway along the road, he is not obliged to provide him another; rather, he gives him his hire for half the road and leaves him its carcass. Hagah [Rema]: And there are those who disagree and hold that even if he hired it for a load, its law is as if he hired it for riding (Tur in the name of the Raavad). And what we say, that he gives him his hire for half the road, means where he can sell his merchandise there, or can hire another donkey to the place where he wishes to go; but otherwise he gives him nothing of his hire, for it has been of no use to him at all (Tur).
Se’if 3ג׳
ראובן השכיר בהמתו לשני ימים לילך ולחזור ובחזרתו ביום השני גדל הנהר עד שהוצרך לעכב יום אחד אם שכרה לימים פשיטא שצריך ליתן לו שכירות כל יום ויום ואם שכרה למקום פלוני ולחזור או ששכרה לשני ימים והזכיר המקום שרוצה לילך שם וידוע שהוא מהלך שני ימים ועכבו הנהר אם לא היה רגיל להתגדל פסידא דבעל בהמה ואם היה רגיל להתגדל והשוכר מכיר ענין הנהר ולא המשכיר פסידא דשוכר ואם שניהם ידעו פסידא דבעל בהמה ומזונות הבהמה והשכירות דין אחד להם:
Reuven hired out his animal for two days, to go and to return; and on his return, on the second day, the river rose, so that he had to wait one day. If he hired it by the day, it is obvious that he must give him the hire for each and every day. And if he hired it to such-and-such a place and back, or hired it for two days and mentioned the place where he wished to go, and it is known that it is a two-day journey, and the river held him back: if it was not usual for it to rise, the loss is the owner of the animal's; and if it was usual for it to rise, and the hirer knew the ways of the river and the one who hired it out did not, the loss is the hirer's; and if both of them knew, the loss is the owner of the animal's. And the animal's food and the hire have one law.
