Se’if 1א׳
השוכר את הבהמה לילך למקום ידוע והוליכה למקום אחד. ובו ה סעיפים: השוכר את החמור להוליכה בהר והוליכה בבקעה אם הוחלקה פטור אע"פ שעבר על דעת הבעלים ואם הוחמה חייב:
One who hires the animal to go to a known place and took it to another place; it contains five se'ifim. One who hires the donkey to take it over the mountain and took it through the valley: if it slipped, he is exempt, even though he went against the owner's wishes; and if it became overheated, he is liable.
Se’if 2ב׳
שכרה להוליכה בבקעה והוליכה בהר אם הוחלקה חייב שהחלקות יותר בהר מבבקעה ואם הוחמה פטור שבבקעה חמימות יותר מבהר מפני הרוח שמנשבת בראש ההרים ואם הוחמה מחמת המעלה חייב וכן כל כיוצא בזה: הגה שינה מהר לבקעה ומבקעה להר ונתייגעה ומתה חייב וכן אם שכרה להוליכה למקום אחד והוליכ' למקום אחר ואויר הדרך משונה מבמקום אחר חייב וכן כל כיוצא בזה (טור):
If he hired it to take it through the valley and took it over the mountain: if it slipped, he is liable, for slipping is more common on the mountain than in the valley; and if it became overheated, he is exempt, for in the valley there is more heat than on the mountain, because of the wind that blows on the mountaintops. And if it became overheated because of the ascent, he is liable; and likewise in every case like this. Hagah [Rema]: If he changed from mountain to valley or from valley to mountain, and it grew weary and died, he is liable. And likewise if he hired it to take it to one place and took it to another place, and the air of that road differs from that of the other place, he is liable; and likewise in every case like this (Tur).

השכיר בהמתו לילך בה למקום פלוני ולהחזירה למחר והלך השוכר עליה למקום ההוא והחזירה בו ביום ונתרעם המשכיר לזקני העיר על אשר הוליכה והביאה ביום א' ואמרו למשכיר לקבלה ולהשתדל ברפואתה וכן עשה ומתה לסוף ח' ימים חייב השוכר כיון שפשע בה: הגה השוכר את החמור ונעשה פסח בדרך ולא חש לכך והניח עליו משוי ונתקלקלה הוי פשיעה דלא ה"ל להניח עליו משוי אבל אם היה נחוץ לדרכו ולא היה אפשר לשכור חמור אחר לא הוי פשיעה ופטור (הרא"ש כלל צ"ב סי' ג'):
One who hired out his animal for going with it to such-and-such a place and bringing it back the next day, and the hirer went on it to that place and brought it back on the same day; and the one who hired it out complained to the elders of the town that he had taken it there and brought it back in one day, and they told the one who hired it out to accept it and to take pains over its healing; and he did so, and it died at the end of eight days — the hirer is liable, since he was negligent with it. Hagah [Rema]: One who hires the donkey, and it became lame on the way, and he paid no heed to this and put a load on it, and it was ruined — this is negligence, for he ought not to have put a load on it. But if he was pressed for his journey and it was not possible to hire another donkey, it is not negligence, and he is exempt (the Rosh, klal 92, siman 3).
