Se’if 1א׳
דיני השוכר וחיובו ופטורו ואם השאיל או השכיר. ובו ז סעיפים: השוכר מחבירו בהמה או כלים דינו כשומר שכר להתחייב בגניבה ואבידה וליפטר מאונסין:
The laws of the hirer, his liability and his exemption, and if he lent or hired it out; it contains seven se'ifim. One who hires an animal or vessels from his fellow — his law is as a paid bailee's: to be liable for theft and loss and exempt from mishaps.
Se’if 2ב׳
יכולין המשכיר והשוכר לחזור בהם עד שימשוך או שיעשה א' מדרכי הקנין וכן אינו מתחייב בגניבה ואבידה עד שיעשה אחד מדרכי הקנייה וי"א שמשסילק הבעל שמירתו מעליו מדעת השומר נתחייב בשמירתה:
The one who hired it out and the hirer can retract until he draws it, or makes one of the ways of acquisition; and likewise he is not liable for theft and loss until he makes one of the ways of acquisition. And some say that once the owner has removed his guarding from it with the bailee's knowledge, he has become liable for guarding it.
Se’if 3ג׳
ראובן שכר בית משמעון ונתן שם חטה ומחמת שעמדה שם ימים הרבה נתקלקלו הכותלים ונפלו והזיקו לשמעון ולשכניו אם היה ניכר וידוע קלקול הכותלים והתרו בו לסלק החטה ולא סלקה פושע הוא וחייב לשלם כל ההיזק:
Reuven hired a house from Shimon and put wheat there, and because it stood there many days the walls were spoiled and fell and damaged Shimon and his neighbours: if the damage to the walls was recognisable and known, and they warned him to remove the wheat and he did not remove it, he is negligent and liable to pay all the damage.
