Se’if 1א׳

האומנים שומרי שכר ואם קלקלו וטבח שנבל. ובו ח סעיפים: כל האומנים שומרי שכר הם וכולם שאמרו טול את שלך והבא מעות או שא"ל האומן גמרתיו ולא לקחו הבעלים הכלי הרי האומן שומר חנם אבל אם אמר האומן הבא מעות וטול את שלך עדיין הוא שומר שכר כמו שהיה (ואם אמר טול את שלך ואיני שומרו עוד פטור) (ב"י בשם תלמידי הרשב"א):

Craftsmen are paid bailees; and if they spoiled a thing; and a butcher who made the animal a nevelah (an animal that died without valid slaughter); it contains eight se'ifim. All craftsmen are paid bailees. And all of them who said, "Take yours and bring money", or the craftsman said to him, "I have finished it", and the owner did not take the vessel — the craftsman is an unpaid bailee. But if the craftsman said, "Bring money and take yours", he is still a paid bailee, as he was (and if he said, "Take yours, and I no longer guard it", he is exempt) (Beit Yosef in the name of the students of the Rashba).

נתן לאומנים לתקן וקלקלו חייבים לשלם כיצד נתן לחרש שידה תיבה ומגדל לקבוע בהם מסמר ושברו או נתן לו עצים לעשות מהם שידה תיבה ומגדל ונשברו אחר שנעשו משלם לו דמי שידה תיבה ומגדל שאין האומן קונה בשבח כלי עי' בא"ע סי' כ"ח סט"ו: הגה הבנאי שקבל עליו לסתור הכותל ושבר האבנים או הזיקם חייב לשלם היה סותר מצד זה ונפל מצד אחר פטור ואם מחמת המכה חייב (טור ס"ה):

If he gave to craftsmen to repair, and they spoiled it, they are liable to pay. How so? If he gave to a carpenter a chest, a box and a cupboard to fix a nail in them, and he broke them; or he gave him wood to make of it a chest, a box and a cupboard, and they were broken after they were made — he pays him the value of a chest, a box and a cupboard, for the craftsman does not acquire by the improvement of the vessel; see Even HaEzer, siman 28, se'if 15. Hagah [Rema]: The builder who undertook to pull down the wall, and broke the stones or damaged them, is liable to pay. If he was pulling down on this side and it fell on another side, he is exempt; and if it was because of the blow, he is liable (Tur, se'if 5).

נתן צמר לצבע והקדיחתו יורה נותן לו דמי צמרו צבעו כעור או נתנו לו לצבעו אדום וצבעו שחור שחור וצבעו אדום נתן עצים לחרש לעשות מהם כסא נאה ועש' כסא רע או ספסל אם השבח יתר על ההוצאה נותן בעל הכלי את ההוצאה ואם ההוצאה יתירה על השבח נותן לו את השבח בלבד (ומה שהיה ראוי להשביח אילו לא שינה היא בכלל הקרן וחשבינן השבח (וההוצאה) בלא זה) (טור) אמר בעל הכלי איני רוצה בתקנה זו אלא יתן לי דמי הצמר או דמי העצים אין שומעין לו וכן אם אמר האומן הא לך דמי צמרך או דמי עציך ולך אין שומעין לו שאין האומן קונה בשבח כלי שעשה:

If he gave wool to a dyer and the cauldron scorched it, he gives him the value of his wool. If he dyed it ugly, or they gave it to him to dye red and he dyed it black, or black and he dyed it red; if he gave wood to a carpenter to make of it a fine chair and he made a poor chair or a bench — if the improvement exceeds the outlay, the owner of the vessel gives the outlay; and if the outlay exceeds the improvement, he gives him the improvement only (and what it would have improved had he not deviated is included in the principal, and we reckon the improvement, and the outlay, without this) (Tur). If the owner of the vessel said, "I do not want this repair, but let him give me the value of the wool or the value of the wood", they do not listen to him. And likewise if the craftsman said, "Here is the value of your wool, or the value of your wood, and go", they do not listen to him; for the craftsman does not acquire by the improvement of the vessel he made.
