Se’if 1א׳
שומר שכופר או שטוען נאנס או נגנב. ובו ז סעיפים: שומר שכר דינו כש"ח לענין אם כפר או טענות אחרות שביניהם כגון אם אמר לו נשתמשת בחפץ וקלקלתו וכיוצא בזה נשבע היסת ונפטר ואם השומר טוען שנאנסה אם במקום שעדים מצויים יביא עדים ויפטר או ישלם ואם אין מצוים ישבע שהיא כדבריו ויכלול בשבועתו שלא שלח בה יד ושאינה ברשותו ואם טוען נגנבה או אפי' שאומר פשעתי בה והריני משלם משביעין אותו שאינו ברשותו:
A bailee who denies, or who pleads that it was lost by mishap or stolen; it contains seven se'ifim. A paid bailee — his law is as an unpaid bailee's as to whether he denied, or other pleas between them; for example, if he said to him, "You used the object and spoiled it", and the like, he swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) and is quit. And if the bailee pleads that it was lost by mishap: if in a place where witnesses are common, he brings witnesses and is quit, or pays; and if they are not common, he swears that it is as he says, and includes in his oath that he did not put forth his hand to it and that it is not in his domain. And if he pleads that it was stolen, or even says, "I was negligent with it and I will pay", they make him swear that it is not in his domain.
Se’if 2ב׳
נגנבה בלסטים מזויין והוכר הגנב צריך לפרוע לבעל הבית והוא יעמיד הגנב בדין ואפילו אם נשבע כבר ונפטר קודם והוכר הגנב כיון שנמצא הגנב צריך להעמידו בדין והוא יפרע לבע"ה:
If it was stolen by an armed robber and the thief became known, he must pay the householder, and he takes the thief to judgment. And even if he had already sworn and been quit before, and the thief became known — since the thief has been found, he must take him to judgment, and he pays the householder.
Se’if 3ג׳
היו הבעלים עמו במלאכתו בשעה שמשך החפץ לשמור פטור אף מפשיעה כמו שנתבאר בדיני ש"ח:
If the owner was with him in his work at the time he drew the object to guard it, he is exempt even from negligence, as was explained in the laws of the unpaid bailee.
