המעביר חבית ממקום למקום ונשבר מתי חייב. ובו ו סעיפים: המעביר חבית ממקום למקום בשכר ונשברה דין תורה הוא שישלם שאין זה אונס גדול והרי השבירה כגניבה ואבידה שהוא חייב בהן אבל תקנו חכמים שיהיה חייב שבועה שלא פשע בה שאם אתה אומר ישלם אין לך אדם שיעביר חבית לחבירו ולפיכך עשו בו שבירת החבית כמיתת הבהמה ושבירתה:
One who carries a barrel from place to place and it broke: when he is liable; it contains six se'ifim. One who carries a barrel from place to place for pay, and it broke — the law of the Torah is that he pays, for this is not a great mishap, and the breaking is as theft and loss, for which he is liable. But the Sages enacted that he be liable to an oath that he was not negligent with it; for if you say that he pays, there would be no man who would carry a barrel for his fellow. And therefore they made the breaking of the barrel as the death of an animal and its breaking a limb.
Se’if 2ב׳
ועוד תקנו בדבר זה שאם נשאו אותה שנים במוט ונשברה משלמים חצי הואיל ומשאוי זה גדול לגבי אחד וקל לגבי שנים הוי כאונס ואינו אונס ומשלמים מחצה אם יש עדים שלא פשעו בה:
And they further enacted in this matter that if two carried it on a pole and it broke, they pay half; since this load is heavy for one and light for two, it is like a mishap and is not a mishap, and they pay half, if there are witnesses that they were not negligent with it.
Se’if 3ג׳
נשברה במקום שאין עדים מצוים נשבעים שלא שברוה בפשיעה ומשלמים חצי דמיה שהרי לא היה לכל א' להעביר אלא משוי שהיה יכול להעביר בפ"ע:
If it broke in a place where witnesses are not common, they swear that they did not break it through negligence, and they pay half its value; for each one ought to have carried only a load that he could carry by himself.
Se’if 4ד׳
מכאן אתה למד שהאחד שהעביר חבית גדולה שאין דרך כל הסבלים להעבירה ביחיד שהוא פושע ואם נשברה בידו משלם הכל: הגה כל זה לשון הרמב"ם ודעתו אבל יש חולקים וסבירא להו דכל שהוא קל לשנים אע"פ שהוא כבד לאחד לא מיקרי פושע גמור ואינו משלם רק מחצה (טור ס"ג והמגיד פ"ד דשכירות):
From this you learn that one man who carried a large barrel, which it is not the way of any porters to carry singly, is negligent; and if it broke in his hand, he pays all of it. Hagah [Rema]: All this is the language of the Rambam and his opinion; but there are those who disagree and hold that whatever is light for two, even though it is heavy for one, is not called outright negligence, and he pays only half (Tur, se'if 3, and the Maggid, chapter 4 of the Laws of Hire).

הסבל ששבר חבית של יין לחנוני ונתחייב לשלם והרי הוא שוה ביום השוק ד' ובשאר ימים ג' אם החזירו ביום השוק חייבים להחזיר חבית של יין או ישלמו לו ארבע והוא שלא היה לו יין למכור ביום השוק אבל אם היה לו יין מחזירין לו שלשה ואם החזירו לו בשאר ימים מחזירין לו שלשה ומנכין לו בכל זמן טורח שהיה טורח במכירתה ופגם הנקב שהיה נוקב החבית וכן כל כיוצא בזה: הגה גם זה ל' הרמב"ם ודעתו אבל רוב המפרשים חולקים וסבירא להו בהפך שאם שבר בשאר הימים משלם ג' ואם שברו ביום השוק אם בא לפורעו בשאר הימים צריך ליתן לו ארבע ואינו נפטר אם רוצה ליתן לו חבית אחר של יין אבל אם בא לפורעו ביום השוק יכול להחזיר לו חבית אחר של יין והוא שאין לו יין אחר למכור בשוק אבל אם יש לו יין אחר הרי הוא אצלו כשאר ימים וצריך ליתן לו דמי היין (טור בשם הרא"ש):
A porter who broke a shopkeeper's barrel of wine and became liable to pay, and it is worth four on market day and three on other days: if they repaid him on market day, they must return a barrel of wine or pay him four — and this is where he had no wine to sell on market day; but if he had wine, they return him three. And if they repaid him on other days, they return him three. And at any time they deduct for him the trouble he would have taken in selling it, and the depreciation from the hole with which he would have bored the barrel; and likewise in every case like this. Hagah [Rema]: This too is the language of the Rambam and his opinion; but most of the commentators disagree and hold the reverse: that if he broke it on the other days, he pays three; and if he broke it on market day, then if he comes to repay him on the other days he must give him four, and he is not quit if he wishes to give him another barrel of wine; but if he comes to repay him on market day, he can return him another barrel of wine — and this is where he has no other wine to sell in the market; but if he has other wine, it is for him as the other days, and he must give him the value of the wine (Tur in the name of the Rosh).
