Se’if 1א׳

שומר שכר באיזה דבר חייב או פטור ומאימתי מתחייב. ובו טו סעיפים: שומר שכר גם הוא אינו מתחייב בשמירתו עד שימשוך במקום שראוי למשוך כמו שנתבאר בסי'רצ"א בש"ח: הגה י"א אדם ששולח לחבירו שום דבר להוליכו למקום אחד ובתוך כך שלח לו דורון הוי שומר שכר (הגהות מרדכי פרק איזהו נשך וע' בב"י) ראובן שאמר לשמעון יש לך חפץ פלוני למכור אשרתך ואמכרנו ושמעון אומר תנהו בכך וכך והמותר יהא שלך נעשה ראובן שומר שכר עליו אע"פ ששתק כשקבלו (מהרי"ק שורש קנ"ה):

A paid bailee: for what he is liable or exempt, and from when he becomes liable; it contains fifteen se'ifim. A paid bailee too does not become liable for his guarding until he draws it, in a place where it is fit to draw, as was explained in siman 291 regarding the unpaid bailee. Hagah [Rema]: Some say that a man who sends his fellow something to carry it to a certain place, and meanwhile sent him a gift, is a paid bailee (Hagahot Mordechai, chapter "Which is interest", and see Beit Yosef). Reuven, who said to Shimon, "You have such-and-such an object to sell; I will do you a service and sell it", and Shimon says, "Give it for such-and-such, and the surplus shall be yours" — Reuven becomes a paid bailee over it, even though he was silent when he received it (Maharik, shoresh 155).

שומר שכר חייב בגניבה ואביד' וי"א שאפילו שמר כראוי ונתן הכספים תחת הקרקע בעומק מאה אמה שאי אפשר לגנבם משם אם לא ע"י מחילות או גם בעידנא דניימי אינשי ונגנבו או קפץ עליו חולי ולא יכול לשומרה וכל כיוצא בזה חייב ואפי' הקיפו חומה של ברזל ואפילו אם אילו היה שם לא היה יכול להציל חייב בגניבה ואבידה אא"כ היה שם ולא היה יכול להציל:

A paid bailee is liable for theft and loss. And some say that even if he guarded properly and put the coins under the ground at a depth of a hundred cubits, from where it is impossible to steal them except by tunnels, or even at the time when people sleep, and they were stolen; or a sickness seized him and he could not guard it, and everything like this — he is liable. And even if he surrounded it with a wall of iron, and even if, had he been there, he could not have rescued it, he is liable for theft and loss — unless he was there and could not rescue it.

Se’if 3ג׳

שומר שכר פטור מאונסים איזהו אונס בא עליו לסטים מזויין אפי' אם גם הרועה מזויין לפי שהליסטים מוסר נפשו יותר: הגה אם נפלה דליקה בעיר ונשרפו החפצים שהיה ש"ש עליהם הוי אונס אם לא היה יכול להציל בעצמו ולא ע"י אחרים (מרדכי פ' המפקיד ופ' השואל) ודוקא שיודע בודאי שנשרפו אבל אם אינו יודע בבירור רק שהיו בבית שנשרף אינו יכול לישבע שנשרפו דדילמא עכו"ם נכנסו וגנבו אותו ולכן חייבים לשלם אא"כ עכו"ם הנכנסים הם ליסטים מזויינים דאז ישבע שנשרפו או נגנבו בליסטים מזויינים ופטור (שם):

A paid bailee is exempt from mishaps. What is a mishap? An armed robber came upon him — even if the herdsman too is armed, for the robber risks his life more. Hagah [Rema]: If a fire broke out in the city, and the objects over which he was a paid bailee were burnt, it is a mishap if he could not rescue them himself nor by means of others (Mordechai, chapter "One who deposits", and chapter "One who borrows"). And specifically where he knows for certain that they were burnt; but if he does not know clearly, only that they were in the house that was burnt, he cannot swear that they were burnt, for perhaps gentiles came in and stole it; and therefore they are liable to pay — unless the gentiles who come in are armed robbers, for then he swears that they were burnt or stolen by armed robbers, and he is exempt (there).
