שנים שהפקידו א' ק' וא' ר' וכל אחד תובע ר'. ובו ד סעיפים: שנים שהפקידו אצל אחד זה מנה וזה מאתים וכל א' משניהם אומר אני הוא שהפקדתי המאתים והשומר אומר איני יודע ישבע כל א' מהם שהפקיד ק"ק ויתן ק"ק לזה וק"ק לזה ונמצא מפסיד מנה מביתו מפני שפשע שה"ל לכתוב שם כל א' על כיס שלו ואי אינהו לא תבעו ליה כל חד בברי אם בא לצאת ידי שמים חייב אבל בדיני אדם פטור לפיכך אם הביאו לו השנים כא' שלש מאות בכרך אחד ובאו ותבעו וכל א' אומר הק"ק שלי נותן מאה לזה ומאה לזה והשאר יהא מונח אצלו (וי"א דיהא מונח ביד ב"ד) (מרדכי פ' המפקיד וע' בב"י) עד לעולם או עד שיודה האחד לחבירו שהרי הוא אומר להם כיון שראיתי שאינכם מקפידין זה על זה והבאתם בכרך א' לא הטרחתי עצמי לידע ולזכור תמיד מי בעל המאה ומי בעל המאתים ואפי' בבא לצאת ידי שמים פטור (וי"א דאם תבעו ליה חייב בבא לצאת ידי שמים אפילו בכי האי גוונא) (טור):
Two who deposited, one a hundred and one two hundred, and each claims two hundred; it contains four se'ifim. Two who deposited with one man, this one a maneh and that one two hundred, and each of the two says, "I am the one who deposited the two hundred", and the bailee says, "I do not know" — each of them swears that he deposited two hundred, and he gives two hundred to this one and two hundred to that one, and he is found to lose a maneh from his own house, because he was negligent, for he should have written each one's name on his purse. And if they did not each claim it of him with certainty, then if he comes to fulfil his duty to Heaven he is liable, but by the laws of man he is exempt. Therefore, if the two of them brought him three hundred together in one bundle, and they came and claimed, and each says, "The two hundred is mine", he gives a hundred to this one and a hundred to that one, and the rest lies with him (and some say that it lies in the hand of the court) (Mordechai, chapter "One who deposits", and see Beit Yosef) for ever, or until one admits to his fellow. For he says to them, "Since I saw that you were not particular with one another, and brought it in one bundle, I did not trouble myself to know and to remember always who was the owner of the hundred and who the owner of the two hundred"; and even when he comes to fulfil his duty to Heaven he is exempt (and some say that if they claimed it of him he is liable when he comes to fulfil his duty to Heaven, even in such a case) (Tur).
Se’if 2ב׳
וכן אם הפקידו אצלו שני כלים א' גדול וא' קטן וכל א' אומר אני בעל הגדול ישבעו שניהם ויתן הגדול לא' מהם ודמי הגדול לשני וישאר לו הקטן ואם הביאום בכרך א' כאחד נותן הקטן לאח' ודמי הקטן לשני והשאר יהיה מונח עד שיודה האחד לחבירו או עד לעולם:
And likewise if they deposited with him two vessels, one large and one small, and each says, "I am the owner of the large one" — both of them swear, and he gives the large one to one of them and the value of the large one to the second, and the small one remains his. And if they brought them together in one bundle, he gives the small one to one and the value of the small one to the second, and the rest lies until one admits to his fellow, or for ever.
Se’if 3ג׳
וכן מי שתבעוהו שנים זה אומר אני הוא בעל הפקדון וזה אומר אני הוא והשומר אומר א' מכם הוא ואיני יודע מי הוא ישלם לשניהם: ואי אינהו לא תבעי ליה פטור אפי' בבא לצאת ידי שמים אבל אם אמר אביכם של אחד מכם הפקיד אצלי ואיני יודע איזה מכם חייב בבא לצאת ידי שמים (טור):
And likewise one against whom two claimed — this one says, "I am the owner of the deposit", and that one says, "It is I" — and the bailee says, "It is one of you, and I do not know which he is": he pays both of them. And if they did not claim it of him, he is exempt even when he comes to fulfil his duty to Heaven. But if he said, "The father of one of you deposited it with me, and I do not know which of you", he is liable when he comes to fulfil his duty to Heaven (Tur).
