נפקד אומר איני יודע במה אני חייב והמפקיד טוען ברי. ובו ב סעיפים: כל שומר שנתחייב לשלם ואמר איני יודע כמה דמים אני חייב לשלם והבעלים אומרים אנו יודעים כך וכך היה שוה כגון שהפקיד אצלו כיס מלא זהובים ופשע בו הבעלים אומרים ק"ק דינרים היו והשומר אומר ודאי שהיה בו דינרים אבל איני יודע כמה היו נמצא זה כטוען ק"ק ומודה לו במקצת ואמר השאר איני יודע שהוא מחוייב שבועה ואינו יכול לישבע ומשלם ולפיכך הבעלים יטלו בלא שבועה והוא שיטענו דבר שהם אמודים בו ויש לשומר להחרים על מי שלקח ממנו יותר מהראוי לו (וע"ל סי' צ' סעיף י'):
The bailee says "I do not know how much I owe", and the depositor claims with certainty; it contains two se'ifim. Every bailee who became liable to pay and said, "I do not know how much I am liable to pay", and the owner says, "We know that it was worth such-and-such" — for example, he deposited with him a purse full of gold pieces and he was negligent with it, and the owner says, "There were two hundred dinars", and the bailee says, "Certainly there were dinars in it, but I do not know how many there were" — this one is found to be like one who claims two hundred, and he admits part of it and says, "The rest I do not know", so that he is liable to an oath and cannot swear, and he pays. And therefore the owner takes without an oath; and this is where they claim a thing that they are assessed as having. And the bailee may pronounce a cherem (the severer form of the ban) upon whoever took from him more than is due to him (and see above, siman 90, se'if 10).

מת אביו והניח לו שק צרור והפקידו אצל חבירו ופשע בו המפקיד אומר איני יודע מה היה בו שמא מרגליות היו בו וכן השומר אומר איני יודע כמה אני חייב לשלם שמא זכוכית היה מלא ישבע השומר כתקנת חכמים שאינו ברשותו ויכלול בשבועתו שאינו יודע בודאי שהיה בו יותר על שוה כך וכך וישלם מה שהודה לו (מפקיד שאמר נגנב לי מן הפקדון והשומר אומר איני יודע נשבע שאינו יודע ופטור) (תשו' רשב"א סי' אלף קל"ד):
His father died and left him a bound sack, and he deposited it with his fellow, and he was negligent with it. The depositor says, "I do not know what was in it; perhaps there were pearls in it", and likewise the bailee says, "I do not know how much I am liable to pay; perhaps it was full of glass" — the bailee swears, by the ordinance of the Sages, that it is not in his domain, and includes in his oath that he does not know for certain that there was in it more than such-and-such a value, and he pays what he admitted to him (a depositor who said, "Some of the deposit was stolen from me", and the bailee says, "I do not know" — he swears that he does not know, and is exempt) (responsum of the Rashba, siman 1134).
