Se’if 1א׳
שילם הנפקד כיצד משביעין אותו. ובו ג סעיפים: שומר חנם שאמר הריני משלם ואיני נשבע אם היה הפקדון דבר שכל מינו שוה ומצוי בשוק לקנות כמותו כגון פירות או יריעות של צמר ושל פשתן השוות בכל ענינים או קורות שאינם מצויירות וכל כיוצא בהם ה"ז משלם ואינו נשבע אבל אם היה הפקדון [ בהמה או] בגד מצוייר או כלי מתוקן או דבר שאינו מוצא לקנות כמותו בשוק חוששין שמא עיניו נתן בו ומשביעים אותו בנקיטת חפץ שאינו ברשותו ואח"כ משלם וה"ה לשאר השומרים כגון השואל שאמר מתה או נגנבה ושומר שכר והשוכר שאמרו נגנבה או אבדה אע"פ שהם חייבים לשלם משביעים אותם שבועה שאינה ברשותם ואח"כ משלמים דמי הבהמה או החפץ שאנו חוששים לו שמא עיניו נתן בה ואם אמרו הבעלים יתר על זה היה שוה כולל בשבועתו שאינו שוה אלא כך וכך:
A bailee who pays: how they make him swear; it contains three se'ifim. An unpaid bailee who said, "I will pay and not swear": if the deposit was a thing all of whose kind is alike and is to be found in the market to buy its like — for example produce, or sheets of wool and of linen that are alike in every respect, or beams that are not decorated, and everything like them — he pays and does not swear. But if the deposit was an animal, or a decorated garment, or a finished vessel, or a thing whose like he does not find to buy in the market, we are concerned lest he has set his eyes on it, and they make him swear, holding a sacred object, that it is not in his domain, and afterwards he pays. And the same is the law with the other bailees — for example the borrower who said it died or was stolen, and the paid bailee and the hirer who said it was stolen or lost: even though they are liable to pay, they make them swear an oath that it is not in their domain, and afterwards they pay the value of the animal or of the object, since we are concerned about him lest he has set his eyes on it. And if the owner said that it was worth more than this, he includes in his oath that it was worth only such-and-such.
Se’if 2ב׳
נמצא כל שומר שנשבע שבועת השומרים כולל בשבועתו ג' דברים ששמר כדרך השומרים ושאירעו כך וכך ושאינו ברשותו ושלא שלח בו יד קודם שאירעו המאורע הפוטר אותו ואם רצה לשלם נשבע שאינו ברשותו וכולל בשבועתו שכך וכך הי' שוה שילם ולא רצה לישבע ואח"כ הוכר הגנב קנה כל שבח דאתי מעלמא אבל לא שבח דמגופא (טור):
It follows that every bailee who swears the oath of the bailees includes three things in his oath: that he guarded it in the way of bailees, and that such-and-such befell it, and that it is not in his domain; and that he did not put forth his hand to it before the occurrence that exempts him befell it. And if he wishes to pay, he swears that it is not in his domain, and includes in his oath that it was worth such-and-such. If he paid and did not wish to swear, and afterwards the thief became known, he acquires all improvement that comes from outside, but not improvement from its own body (Tur).
Se’if 3ג׳
יש מי שאומר שאפי' היה הדבר המופקד או המושכר או השאול שוה פרוטה הרי השומר נשבע עליו ואין א' מהשומרים צריך להודאה במקצת ולא לכפירה במקצת ורבו החולקים עליו במה שכתב שאפי' היה הדבר המופקד שוה פרוטה נשבע עליו ואומרים שצריכים כפירת שתי כסף:
There is one who says that even if the thing deposited, or hired, or borrowed was worth a perutah, the bailee swears on it, and none of the bailees requires an admission of part or a denial of part. And many disagree with him in what he wrote, that even if the thing deposited was worth a perutah he swears on it; and they say that a denial of two silver ma'ot is required.
