Se’if 1א׳
מתי ניתן הפקדון ליתבע ואם יכול להחזירו בכל מקום. ובו ד סעיפים: אין המפקיד יכול לתבוע הפקדון אלא במקום שהפקידו לשם שאם הפקידו אצלו בטבריא אינו יכול לתובעו בצפורי אבל בכל מקום שירצה הנפקד להחזיר למפקיד פקדונו צריך לקבלו אפי' נתנו לו בעל כרחו חשיבה נתינה ופטור (ודוקא שנתנו לו אבל אם אמר להביא לו והמפקיד הלך לו חייב הנפקד) (מרדכי פרק מי שאחזו) ואם הפקידו אצלו לזמן ידוע אינו יכול להכריחו לקבלו ממנו תוך הזמן:
When a deposit may be claimed, and whether he can return it in any place; it contains four se'ifim. The depositor can claim the deposit only in the place where he deposited it with him; for if he deposited it with him in Tiberias, he cannot claim it from him in Tzippori. But in any place where the bailee wishes to return his deposit to the depositor, he must accept it; even if he gave it to him against his will, it counts as a giving and he is exempt (and specifically where he gave it to him; but if he told him to bring it to him and the depositor went away, the bailee is liable) (Mordechai, chapter "One who was seized"). And if he deposited it with him for a set time, he cannot compel him to accept it from him within the time.
Se’if 2ב׳
בד"א בישוב אבל אם הפקיד אצלו בישוב והביא פקדונו במדבר אינו מקבלו ממנו אלא יאמר לו הרי הוא באחריותך עד שתחזירנו לי ביישוב כדרך שהפקדתיו אצלך ביישוב ואם כשהפקידו אצלו אמר לו אני רוצה לצאת למדבר והשיב הנפקד גם אני רוצה לילך למדבר הוי כאילו פירש לו על מנת שאחזירנו לך במדבר ויכול להחזיר לו במדבר:
In what case are these words said? In a settled place. But if he deposited it with him in a settled place and he brought his deposit to him in the wilderness, he does not accept it from him; rather, he says to him, "It is at your risk until you return it to me in a settled place, as I deposited it with you in a settled place". And if, when he deposited it with him, he said to him, "I wish to go out to the wilderness", and the bailee answered, "I too wish to go to the wilderness", it is as though he had specified to him, "On condition that I return it to you in the wilderness", and he can return it to him in the wilderness.

המפקיד אצל חבירו והלך בעל הפקדון למדינת הים והנפקד רוצה לפרש בים או לצאת בשיירא אם בא והביא הפקדון לב"ד נפטר מאחריות שמירתו שאין אוסרים זה במדינה זו מפני פקדון של זה שהלך [ואי אפשר] (וא"א) לו להוליכה עמו שמא יארע לו אונס ויהיה חייב באחריותו ב"ד מפקידים ביד אדם נאמן אצלם מפני השבת אבידה לבעלים: הגה ואם לא היה יכול להניחו בישוב והוצרך להוליכו עמו למדבר מכח סכנה או מכח שומר שמסר לשומר ונאנס מידו י"א דפטור הנפקד (מרדכי פ' הגוזל):
One who deposits with his fellow, and the owner of the deposit went overseas, and the bailee wishes to set out by sea or to go out with a caravan: if he came and brought the deposit to the court, he is quit of the responsibility of guarding it, for this man is not tied down in this country because of the deposit of that one who went away, and it is not possible for him to take it with him, lest a mishap befall him and he bear responsibility for it. The court deposits it in the hand of a man trustworthy in their eyes, because of restoring a lost thing to its owner. Hagah [Rema]: And if he could not leave it in a settled place and had to take it with him to the wilderness, by reason of danger, or by reason of a bailee who handed over to a bailee, and it was lost by mishap from his hand — some say that the bailee is exempt (Mordechai, chapter "One who robs").
