Se’if 1א׳

שלא לשלוח יד בפקדון ואם שלח בו יד. ובו כב סעיפים: אין הנפקד רשאי לשלוח יד בפקדון ואם שלח יד אפי' אינו מכוין לגוזלו אלא להשתמש בו קם ליה ברשותיה וחייב באונסים אע"פ שעדיין לא נשתמש בו דשליחות יד אינה צריכה חסרון רק שיגביהנה כדי להשתמש בה בתשמיש שמחסרו אז חייב כאלו חסרו אבל אם הגביהו לעשות בו תשמיש שאינו מחסרו אינו חייב משעת הגבהה אלא משעת תשמיש ולא משום שליחות יד שהרי אינו שולח בו יד כיון שאינו מחסרו אלא מפני שהוא שואל שלא מדעת דהוי כגזלן: הגה ואם החזירה למקום שנטלה משם חזר להיות דינו כשומר הואיל ולא הוי עליו מתחלה רק שואל בעלמא (מרדכי פ' הגוזל בתרא) ובמעות בכה"ג חייב באונסין (טור סי"א וע' לקמן ס"ו):

Not to put forth one's hand to a deposit, and if he put forth his hand to it; it contains twenty-two se'ifim. The bailee is not permitted to put forth his hand to the deposit. And if he put forth his hand — even if he does not intend to rob it, but only to use it — it has come into his domain and he is liable for mishaps, even though he has not yet used it; for putting forth one's hand does not require a diminution, but only that he lift it in order to make a use of it that diminishes it — then he is liable as though he had diminished it. But if he lifted it to make a use of it that does not diminish it, he is not liable from the time of lifting but from the time of use; and not because of putting forth one's hand, for he does not put forth his hand to it, since he does not diminish it, but because he is one who borrows without the owner's knowledge, who is as a robber. Hagah [Rema]: And if he returned it to the place from which he took it, his law goes back to being that of a bailee, since from the outset he was nothing but a mere borrower upon it (Mordechai, chapter "One who robs, the latter"). And with money, in such a case, he is liable for mishaps (Tur, se'if 11; and see below, se'if 6).

Se’if 2ב׳

הטה את החבית ונטל ממנה רביעית ונשברה אינו חייב אלא ברביעית כיון שלא הגביהה אבל אם הגביהה כדי ליטול ממנה רביעית חייב אפי' לא נטל אבל אם הגביה את הכיס ליטול ממנה דינר וכיוצא בכיס מדברים שאינם גוף אחד הרי זה ספק אם נתחייב בכל הכיס או לא נתחייב אלא בדינר בלבד:

If he tilted the barrel and took a reviit (a quarter of a log) from it, and it broke, he is liable only for the reviit, since he did not lift it. But if he lifted it in order to take a reviit from it, he is liable even if he did not take. But if he lifted the purse to take a dinar from it — and likewise with a purse of things that are not one body — it is a doubt whether he became liable for the whole purse or became liable only for the dinar.

Se’if 3ג׳

וכן אם הטה ונטל ממנה רביעית והחמיצה חייב בכולה שמחמת שחסרה החמיצה בד"א בחבית של יין שדרכו להחמיץ כשהוא חסר אבל שאר פירות ששלח יד במקצתם ולא הגביהן אינו מתחייב אלא כפי מה שנטל:

And likewise if he tilted it and took a reviit from it, and it soured, he is liable for all of it, for it was because it was diminished that it soured. In what case are these words said? With a barrel of wine, whose way is to sour when it is diminished; but other produce, to part of which he put forth his hand and did not lift it, he becomes liable only according to what he took.
