Se’if 1א׳

דין שומר חנם מאימתי מתחייב בשמירה וכיצד הוא השמירה. ובו כח סעיפים: שומר חנם פטור בשבוע' מגניב' ואביד' ואינו חייב לשלם כ"א בפשיעה:

An unpaid guardian is exempt from taking an oath from theft and loss (of the object) and is not obligated to pay with the exception of negligence.

Se’if 2ב׳

שומר חנם הוא שהפקיד אצלו כסף או כלים או בהמה או כל דבר לשמור והוא קבל עליו לשומרו ואפי' לא קיבל בפי' אלא שאמר לו הנח לפני הוא שומר חנם אבל אם אמר לו הנח לפניך או הנח סתם או שאמר לו הרי הבית לפניך (רמב"ם פ"ב מה' שכירות וטור) אפי' שומר חנם לא הוי ואינו חייב שבועה כלל אבל מחרים על מי שלקח פקדון שלו ולא יחזירנו לבעליו ומ"מ מי שהיה מהלך בדרך וא"ל חבירו הולך עמך אלו המנעלים ואמר לו הניחם כאן על החמור והניחם שם ולא קבלם הנפקד בידו אלא כמו שהניחם המפקיד על החמור כך הוליכם ולא קשרם והלך לו מן הצד להסך רגליו והניח החמור על אם הדרך ונאבדו המנעלים הוי שומר חנם והו"ל פושע וחייב לשלם: הגה דלא אמרי' דאם אמר הנח סתם לא הוי שומר חנם אלא במקום המשתמר אבל בדרך וכיוצא בו ודאי קבל עליו שמירה (טור בשם תשובת הרא"ש) ויש חולקין וסבירא להו דאפי' במקום שאינו משתמר לא הוי שומר חנם עד שיאמר הנח לפני (מרדכי פרק האומנים ודעת עצמו מגמרא דפרק האומנין אליבא דחכמים):

An unpaid bailee is one with whom money, or vessels, or an animal, or anything was deposited to guard, and he accepted upon himself to guard it. And even if he did not accept explicitly, but said to him, "Put it down before me", he is an unpaid bailee. But if he said to him, "Put it down before yourself", or "Put it down" without specifying, or said to him, "The house is before you" (the Rambam, chapter 2 of the Laws of Hire, and Tur), he is not even an unpaid bailee, and he is not liable to any oath at all; but he pronounces a cherem (the severer form of the ban) upon whoever took his deposit and will not return it to its owner. And nevertheless, one who was walking on the road, and his fellow said to him, "Take these shoes along with you", and he said to him, "Put them here on the donkey", and he put them there — and the bailee did not receive them into his hand, but carried them just as the depositor had put them on the donkey, and did not tie them, and he went aside to relieve himself and left the donkey at the roadside, and the shoes were lost — he is an unpaid bailee, and he was negligent, and he is liable to pay. Hagah [Rema]: For we do not say that if he said "Put it down" without specifying he is not an unpaid bailee except in a guarded place; but on the road and the like he certainly accepted the guarding upon himself (Tur in the name of a responsum of the Rosh). And there are those who disagree and hold that even in a place that is not guarded he is not an unpaid bailee until he says, "Put it down before me" (Mordechai, chapter "The craftsmen", and his own opinion from the Gemara of chapter "The craftsmen", according to the Sages).

Se’if 3ג׳

בקש מחבירו שיתן רשות להכניס בהמתו או פירותיו לחצרו ונתן לו רשות ולא פירש כלום בשמירתן אינו חייב בשמירתן כלל:

One who asked his fellow to give him permission to bring his animal or his produce into his courtyard, and he gave him permission and specified nothing about guarding them — he is not liable for guarding them at all.
