דין אפוטרופוס מי ימנו וכיצד יתנהג וכל משפטיו. ובו כח סעיפים: מי שמת והניח יורשים קטנים או שאשתו מעוברת או שהניח קטנים וגדולים צריך מורישם למנות להם אפוטרופוס שיתעסק בשביל הקטנים עד שיגדילו ואם לא מינהו ב"ד חייבים להעמיד להם אפוטרופוס עד שיגדילו שב"ד הוא אביהם של יתומים: הגה ואם הבית דין בעצמו רוצים להתעסק בצרכי היתומים הרשות בידן (רשב"א סי' תתקע"ד) מיהו אם צריכים לחלוק או לטעון עם אחרים מחמת היתומים י"א דצריכין להעמיד אפוטרופוס שלא יהיו נראין כעורכי הדיינים וע' לקמן סעיף ח' (ר"ן פ"ב דקידושין) והא דב"ד אביהם של יתומים היינו יתומים קטנים (ר"ן ר"פ שור שנגח ד' וה') וב"ד היינו הממונה בעירו או גדולי הדור אבל אין כח ביד שלשה בעלמא שיעשו עצמן ב"ד על היתומים (הרא"ש כלל פ"ה סי' כ"ו) ואם צוה המוריש שינתן חלק הקטן ויעשה בו מה שירצה הרשות בידו וכן אם מינה המוריש אפוטרופוס על הקטנים קטן או אשה או עבד הרשות בידו: הגה אחד שאמר לש"מ רצונך שאהיה שליט בנכסיך ואמר הן ה"ז ל' אפוטרופוס (ריב"ש סי' ע' וב"י בשם רשב"א) מי שהיה לו אפוטרופוס על נכסיו ומת אין מניחין אותו אפוטרופוס על היתומים אלא ב"ד מעמידין הראוי דלא מקרי מינהו אבי יתומים אלא כשמינהו סמוך למיתתו (הרא"ש ריש כלל ס"ב) ואין מניחין לאדם שאינו ראוי להיות אפוטרופוס אע"פ שמוחזק בנכסים עד שיביא ראיה שמינהו אבי יתומים (מרדכי ר"פ הניזקין):

The law of a guardian: who appoints him, how he conducts himself, and all his laws; it contains twenty-eight se'ifim. One who died and left minor heirs, or whose wife is pregnant, or who left minors and adults — the one they inherit from must appoint a guardian for them, to attend to matters for the minors until they grow up. And if he did not appoint one, the court is obliged to set up a guardian for them until they grow up, for the court is the father of orphans. Hagah [Rema]: And if the court itself wishes to attend to the orphans' needs, the right is theirs (the Rashba, siman 974). However, if they need to divide or to plead with others on account of the orphans, some say that they must set up a guardian, so that they do not appear as advocates; and see below, se'if 8 (the Ran, chapter 2 of Kiddushin). And this, that the court is the father of orphans, means minor orphans (the Ran, beginning of chapter "An ox that gored four and five"). And "the court" means the one appointed in his city, or the great men of the generation; but three ordinary men have no power to make themselves a court over the orphans (the Rosh, klal 85, siman 26). And if the one they inherit from commanded that the minor's share be given and that he do with it as he wishes, the right is his; and likewise if the one they inherit from appointed a minor, or a woman, or a slave as guardian over the minors, the right is his. Hagah [Rema]: One who said to a person dangerously ill, "Is it your wish that I should have control over your property?", and he said, "Yes" — this is the language of guardianship (Rivash, siman 70, and Beit Yosef in the name of the Rashba). One who had a guardian over his property and died — they do not leave him as guardian over the orphans, but the court sets up whoever is fit; for he is not called "appointed by the orphans' father" except when he appointed him near his death (the Rosh, beginning of klal 62). And they do not leave a man who is not fit to be a guardian, even though he is in possession of the property, until he brings proof that the orphans' father appointed him (Mordechai, beginning of chapter "Those who are damaged").

אבל אין ב"ד ממנים אפוטרופס לא אשה לא עבד ולא קטן ולא עם הארץ שהוא בחזקת חשוד על העבירות אלא בודקין אדם נאמן ואיש חיל ויודע להפך בזכות היתומים וטוען טענתם ויש לו כח בעסקי העולם כדי לשמור הנכסים ולהרויח בהם ומעמידים אותו על הקטנים בין שיהיה רחוק בין שיהיה קרוב לקטן אלא שאם היה קרוב לא ירד לקרקעות כמו שנתבאר בסי' רפ"ה (ויכולין ב"ד למנות קרוב שלהן לאפוטרופוס אם ראוי לכך) (ב"י בשם הרשב"א):

But the court does not appoint as guardian a woman, nor a slave, nor a minor, nor an am ha-aretz (one unlearned in the Torah), who is in the presumption of being suspected regarding transgressions. Rather, they seek out a trustworthy man and a capable one, who knows how to turn things to the orphans' merit, and pleads their pleas, and has strength in the affairs of the world, to guard the property and to profit with it; and they set him over the minors, whether he is a stranger or a relative of the minor — except that if he was a relative, he does not go down into the lands, as was explained in siman 285 (and the court can appoint a relative of theirs as guardian if he is fit for it) (Beit Yosef in the name of the Rashba).

כשימנו אותו צריכין ב"ד לחשוב עמו ולכתוב חשבון המטלטלין והקרקעות והחובות וכל דבר שמוסרים בידו דהא על טענת ברי משבעינן ליה לכך צריך שידעו מה שמקבל ומה שמחזיר וכותבים ב' שטרות אות באות אחת לאפוטרופוס ואחת ביד ב"ד בשביל היתומים:

When they appoint him, the court must make an account with him and write down an account of the movables and the lands and the debts and everything they deliver into his hand; for on a claim of certainty we make him swear, therefore they must know what he receives and what he returns. And they write two documents, letter for letter: one for the guardian and one in the hand of the court on behalf of the orphans.
