אחים גדולים וקטנים ורוצים לחלוק. ובו ה סעיפים: מי שהניח יתומים מקצתן גדולים ומקצתן קטנים ורצו לחלוק בנכסי אביהם כדי שיטלו הגדולים חלקם מעמידים ב"ד אפוטרופוס לקטנים ובורר להם החלק היפה (וי"א דצריכים לחלוק בגורל) (טור) ואם הגדילו אינם יכולים למחות שהרי ע"פ ב"ד חלקו להם ואם טעו ב"ד בשומא ופחתו שתות יכולים למחות וחוזרים וחולקים חלוקה אחרת אחר שהגדילו: הגה אבל אפוטרופוס אפי' מינהו אבי יתומים אינו יכול לחלוק בלא ב"ד אא"כ נתמנה בפירוש לכך (תשובת הר"ן סי' ס') ואין לב"ד רשות לחלוק בדבר דשייך ביה גוד או אגוד (טור וכ"כ התוס' בפרק ב' דקידושין והרא"ש בפ' אלמנה ניזונית) וי"ח ומתירין (נ"י פרק הנ"ל ומרדכי שתי הדעות) היו האחין כולם קטנים אין חולקין להם עד שיגדילו אא"כ נראה לב"ד שיש להן תועלת בחלוקה (ב"י בשם הרא"ש והר"ן) וכל שהגיעו הקטנים לי"ג שנה יכולים לחלוק בעצמן דחלוקה לא הוי כמכר (ר"י נכ"ו ח"ב):

Adult and minor brothers who wish to divide; it contains five se'ifim. One who left orphans, some of them adults and some minors, and they wished to divide their father's property so that the adults would take their share — the court appoints a guardian for the minors, and he chooses the fine share for them (and some say that they must divide by lot) (Tur). And if they grew up, they cannot protest, for they divided for them by order of the court. And if the court erred in the appraisal and fell short by a sixth, they can protest, and they go back and make another division after they have grown up. Hagah [Rema]: But a guardian, even if the orphans' father appointed him, cannot divide without the court, unless he was appointed explicitly for this (responsum of the Ran, siman 60). And the court has no power to divide a thing to which god o agod (either you buy my share or you sell me yours, at the price named) applies (Tur; and so wrote the Tosafot in chapter 2 of Kiddushin, and the Rosh in chapter "A widow is maintained"); and some disagree and permit it (Nimukei Yosef, the chapter mentioned above; and Mordechai, both views). If the brothers were all minors, they do not divide for them until they grow up, unless it appears to the court that they have a benefit in the division (Beit Yosef in the name of the Rosh and the Ran). And once the minors have reached thirteen years, they can divide by themselves, for a division is not as a sale (Rabbeinu Yerucham, netiv 26, part 2).

Se’if 2ב׳

אם לא היו כאן כל האחים ואותן שבכאן מבקשים לחלוק או שחלקו ובא אח או בעל חוב ונוטל חלק אחד מהם נתבאר בסימן קע"ה:

If not all the brothers were here, and those who are here seek to divide; or they divided, and a brother or a creditor came and took the share of one of them — it was explained in siman 175.
