Se’if 1א׳
היאך שמין מה שעל בניהם ובנותיהם כשחולקים. ובו ב סעיפים: האחים שחלקו שמין מה שעליהם (וי"א דגדול האחין אין שמין מה שעליו) (טור) אבל מה שעל בניהם ובנותיהם שקנו להם מתפיסת הבית אין שמין וכן מה שעל נשותיהן שכבר זכו בהם לעצמם בד"א בבגדי חול אבל בבגדי שבת ומועד שמין מה שעליהם:
How what is on their sons and daughters is appraised when they divide; it contains two se'ifim. Brothers who divided appraise what they are wearing (and some say that as for the eldest of the brothers, what he is wearing is not appraised) (Tur); but what is on their sons and daughters, which they bought for them from the property held in common by the household, is not appraised; and likewise what is on their wives, for they have already acquired it for themselves. In what case are these words said? With weekday clothes; but with Sabbath and festival clothes, what is on them is appraised.
Se’if 2ב׳
מי שצוה בשעת מיתתו שיתנו לפלוני דקל או שדה מנכסיו וחלקו האחים ולא נתנו לו כלום החלוקה בטלה ויתנו לזה מה שצוה מורישן ואח"כ חוזרים וחולקים בתחלה: הגה ואם ירצה אחד לקיים החלוקה וליתן לו משלו וחבירו יתן לו מעות הרשות בידו (טור בשם הרא"ש):
One who commanded at the time of his death that they give so-and-so a palm tree or a field from his property, and the brothers divided and gave him nothing — the division is void, and they give this man what the one they inherit from commanded, and afterwards they go back and divide anew. Hagah [Rema]: And if one wishes to uphold the division and give it to him from his own, and his fellow gives him money, the right is his (Tur in the name of the Rosh).
