מי שמת והניח בנים גדולים וקטנים. ובו ג סעיפים: מי שמת והניח בנים גדולים וקטנים והשביחו הגדולים את הנכסים כל השבח לאמצע ואפי' שכר עמלם לא יטלו ואם אמרו ראו מה שהניח לנו אבא הרי אנו עושים ואוכלים השבח של משביח והוא שיהיה השבח מחמת הוצאה שהוציא המשביח אבל שבחו נכסים מחמת עצמן השבח לאמצע וכן אם היתה אשתו של מת היא היורשת בכלל אחיותיה או בכלל בנות דודיה והשביחה הנכסים השבח לאמצע ואם אמרה ראו מה שהניח לי בעלי הריני עושה ואוכלת והשביחה הנכסים מחמת הוצאה השבח שלה זהו דעת הרמב"ם לבדו ולא מצינו לו חבר אבל דעת הכל שזה שאמרנו ברישא שאם השביחו גדולים את הנכסים השביחו לאמצע היינו דוקא כששבחו הנכסים מחמת עצמן דהיינו ששכרו פועלי' מממון תפיסת הבית או שנשאו ונתנו בסחור' אבל אם השביחו ע"י שהוציאו הוצאו' משלהם או שטרחו בגופם לחפור ולבנות השבח לעצמן ואם השביחו בדבר שאם היו מודיעים לקטנים גם הם יכולים לעשותו כגון לשמור וכיוצא בו השבח לאמצע אע"פ שטרחו בגופם כיון שלא הודיעום תחלה ואם אמרו ראו מה שהניח לנו אבא הרי אנו עושים ואוכלים כל השבח שהשביחו בכל הנכסים אפי' בחלק האחים הוא של עצמם ואפי' השביחו מחמת נכסים: הגה ואם האחים גדולים א"צ לאומרו בב"ד רק בפני עדים אבל אם יש בהן יתומים קטנים צריך שיאמר אותו בפני ב"ד (טור בשם הרא"ש והמגיד פ"ט דנחלות וב"י בשם הר"ן) וכל זה באחין שניזונין יחד אבל אם אין ניזונין יחד אפילו השביח מחמת עצמו אינו נוטל רק כשאר יורד שלא ברשות לנכסי חבירו (טור בשם הראב"ד) אחד מן האחין שהיו לו בנים הרבה והשביחו הנכסים אינו יכול לומר תנו לי מה שהרויחו בני וכן האחרים אינן יכולים לומר תן לנו מה שאכלו בניך אלא הכל מן האמצע (המגיד פי' דנחלות) א' מן האחין שנתן מתנה לאחרים וראו האחין ושתקו הוי מחילה (נ"י פ"ק דב"ק):

One who died and left adult and minor sons; it contains three se'ifim. One who died and left adult and minor sons, and the adults improved the property — all the improvement goes to the common stock, and they do not take even the wage for their toil. And if they said, "See what our father left us: we will work it and eat", the improvement belongs to the one who improved it. And this is where the improvement came through an outlay that the improver laid out; but if the property improved of itself, the improvement goes to the common stock. And likewise if the dead man's wife was the heiress, among her sisters or among her cousins, and she improved the property, the improvement goes to the common stock; and if she said, "See what my husband left me: I will work it and eat", and the property improved through an outlay, the improvement is hers. This is the opinion of the Rambam alone, and we have not found a colleague for him. But the opinion of all is that what we said at the beginning — that if the adults improved the property, their improvement goes to the common stock — is specifically where the property improved of itself, that is, they hired workers from the money of the property held in common by the household, or they did business in trade; but if they improved it by laying out outlays of their own, or by toiling with their own bodies to dig and to build, the improvement is theirs. And if they improved it by something which, had they informed the minors, they too could have done — for example guarding and the like — the improvement goes to the common stock, even though they toiled with their bodies, since they did not inform them at the outset. And if they said, "See what our father left us: we will work it and eat", all the improvement they made in all the property, even in the brothers' share, is their own, and even if they improved it by means of the property. Hagah [Rema]: And if the brothers are adults, he need not say it in court, but only before witnesses; but if there are minor orphans among them, he must say it before the court (Tur in the name of the Rosh, and the Maggid, chapter 9 of the Laws of Inheritance, and Beit Yosef in the name of the Ran). And all this is with brothers who are maintained together; but if they are not maintained together, even if he improved it by his own means, he takes only as any other who goes down into his fellow's property without permission (Tur in the name of the Raavad). One of the brothers who had many sons, and they improved the property — he cannot say, "Give me what my sons earned"; and likewise the others cannot say, "Give us what your sons ate"; rather, all is from the common stock (the Maggid, chapter 10 of the Laws of Inheritance). One of the brothers who gave a gift to others, and the brothers saw and were silent — it is a waiver (Nimukei Yosef, chapter 1 of Bava Kamma).

Se’if 2ב׳

א' מהאחים שלקח מעות ועשה בהם סחורה אם היה תלמיד חכם גדול שאינו מניח תורתו שעה אחת הרי השכר שלו שאין זה מניח תורתו ומתעסק לצורך אחיו:

One of the brothers who took money and traded with it: if he was a Torah scholar, and a great one, who does not leave his Torah for a single hour, the profit is his, for such a one does not leave his Torah and busy himself for his brothers' needs.

Se’if 3ג׳

מי שירש את אביו והשביח הנכסים ונטע ובנה ואח"כ נודע שיש לו אחים במדינה אחרת אם קטנים הם השבח לאמצע ואם היו גדולים הואיל ולא נודע שיש לו אחים שמין לו כאריס וכן אח שירד לנכסי קטן והשביח אין שמין לו כאריס אלא השבח לאמצע שהרי לא ברשות ירד:

One who inherited from his father and improved the property, and planted and built, and afterwards it became known that he had brothers in another country: if they are minors, the improvement goes to the common stock; and if they were adults, since it was not known that he had brothers, he is appraised as a sharecropper. And likewise a brother who went down into the property of a minor and improved it is not appraised as a sharecropper; rather, the improvement goes to the common stock, for he did not go down with permission.
