Se’if 1א׳
יתומים גדולים וקטנים היאך ניזונים מנכסיהם. ובו ה סעיפים: מי שמת והניח בנים גדולים וקטנים או בנות גדולות וקטנות והגדולי' צריכי' להוציא יותר במלבושים והקטנים צריכים להוציא יותר במזונות אין ניזונים ולובשים מן האמצע אלא חולקין בשוה וכל אחד ילבוש ויזון משלו ודוקא בשמיחו (מחאה מהני אפי' כולם גדולים) (המ"מ פ"ט מה' נחלות) אבל בסתם ניזונים ומתפרנסים אלו עם אלו דסתמן שותפים נינהו ומוחלין זה לזה ויש מי שחולק בזה:
Adult and minor orphans: how they are maintained from their property; it contains five se'ifim. One who died and left adult and minor sons, or adult and minor daughters, and the adults need to spend more on clothing and the minors need to spend more on food — they are not maintained and clothed from the common stock; rather, they divide equally, and each one clothes and maintains himself from his own. And this is specifically where they protested (a protest avails even if all of them are adults) (the Maggid Mishneh, chapter 9 of the Laws of Inheritance); but without a statement they are maintained and provided for together, for without a statement they are partners and waive to one another. And there is one who disagrees about this.
Se’if 2ב׳
בד"א שאין תועלת לקטנים במה שלובשים הגדולים אבל גדול האחים הנושא ונותן בנכסים ויש תועלת לקטנים במה שהוא מלובש יפה כדי שיהיו דבריו נשמעים ה"ז לובש מתפיסת הבית ואם מיחו בידו הרשות בידן:
In what case are these words said? Where the minors have no benefit from what the adults wear. But the eldest of the brothers who does business with the property, and the minors have a benefit in his being well clothed, so that his words will be listened to — he may clothe himself from the property held in common by the household; and if they protested against him, the right is theirs.
Se’if 3ג׳
נשאו גדולים לאחר מיתת אביהם ישאו הקטנים ג"כ מכלל הנכסים ואח"כ יחלוקו נשאו הגדולים בחיי אביהם ואמרו הקטנים לאחר מיתת אביהם הרי אנו נושאים כדרך שנשאתם אתם אין' שומעין להם אלא מה שנתן אביהם נתן: הגה מי ששידך בנו וקצב ליתן נדוניא ומת קודם שנכנס לחופה אין נוטל הנדוניא אלא מחלקו שהרי לא זכה בה בחיי אביו (תשובת מהרי"ו סי' קי"ד) מי שפדאו אביו מן התפיסה מנכין לו אח"כ מחלק ירושתו ולא אמרינן שאביו נתן לו מתנה רק הלוה לו אא"כ יש אומדן דעת שהאב נתן לו במתנה (שם סי' ק"י):
If the adults married after their father's death, the minors also marry out of the whole of the property, and afterwards they divide. If the adults married in their father's lifetime, and the minors said after their father's death, "We will marry in the way that you married", they are not listened to; rather, what their father gave he gave. Hagah [Rema]: One who arranged a match for his son and fixed a dowry to give, and died before he entered the wedding canopy — he takes the dowry only from his own share, for he did not acquire it in his father's lifetime (responsum of the Maharyu, siman 114). One whose father redeemed him from imprisonment — it is deducted afterwards from his share of the inheritance, and we do not say that his father gave it to him as a gift, but rather that he lent it to him, unless there is an assessment of intent that the father gave it to him as a gift (there, siman 110).
