Se’if 1א׳

שבוי שברח והיוצא לדעת מה יעשו בנכסים. ובו י סעיפים: שבוי שנשבה ונשמע שמת וירדו יורשיו לנחלה וחלקו אותם ביניהם אין מוציאין אותם מידם וכן הבורח מחמת סכנה אבל היוצא לדעת ששמעו בו שמת וירדו יורשיו לנכסיו וחולקים מוציאים מידם עד שיביאו ראיה שמת מורישן:

A captive, one who fled, and one who left of his own accord: what is done with their property; it contains ten se'ifim. A captive who was taken captive, and it was heard that he had died, and his heirs entered upon the inheritance and divided it among themselves — it is not taken out of their hands. And likewise one who fled because of danger. But one who left of his own accord, of whom it was heard that he had died, and his heirs entered upon his property and are dividing it — it is taken out of their hands until they bring proof that the one they inherit from has died.

שבוי שנשבה ובורח מחמת סכנות נפשות חייבים ב"ד להתעסק בנכסיהם כיצד עושים כל המטלטלים יהיו מופקדים ביד נאמן ע"פ ב"ד ומורידין לתוך הקרקעות קרובים הראוים לירש כדי לעבוד הקרקעות ולהתעסק בהם עד שיוודע שמתו או ער שיבאו: הגה היו כאן יורשין הרבה קצתן עובדי אדמה וקצתן אינן עובדי אדמה מעמידין ביד עובדי אדמה (טור בשם הרא"ש) וכשיבואו השבוי והבורח שמין אלו הקרובים שהורידו מה שעשו ומה שאכלו כמנהג כל האריסים של אותה מדינה: הגה וי"א דוקא בשבח שמין לו כאריס אבל פירות נוטל הכל (טור בשם ר"י והרא"ש) ואם שמעו שמת קודם שהורידוהו ואח"כ באו אין לו בשבח כלום אלא מה שאכל אכל ומה שהוציא הוציא (שם בשם הרא"ש) ולמה לא יעמידו אפוטרופוס לעולם בין במטלטלין בין בקרקעות עד שיבאו הבעלים או עד שיוודע בוודאי שמתו לפי שאין בית דין חייבים להעמיד אפוטרופוס לגדולים שהם בני דעת: הגה מיהו אם היה כאן מי שרוצה להיות אפוטרופוס לתקנת השבוי מעמידין אותו ואין תקנה גדולה מזו ומיהו היורש יכול למחות שלא למנות אפוטרופוס (טור בשם הרא"ש ונ"י פ' המפקיד) וי"א דאין היורש יכול למחות (המגיד פ"ז דנחלה ומרדכי פרק המפקיד) שוטה דינו כקטן ומעמידין לו אפוטרופוס (ב"י בשם הרשב"א):

A captive who was taken captive, or one who fled because of danger to life: the court is obliged to attend to their property. How is it done? All the movables are deposited in the hand of a trustworthy man by order of the court, and they put relatives who are fit to inherit into the lands, to work the lands and attend to them, until it becomes known that they have died or until they come. Hagah [Rema]: If there were many heirs here, some of them tillers of the soil and some not tillers of the soil, it is placed in the hand of the tillers of the soil (Tur in the name of the Rosh). And when the captive or the one who fled comes, these relatives whom they put in are appraised as to what they did and what they ate, according to the custom of all the sharecroppers of that country. Hagah [Rema]: And some say that it is specifically as to the improvement that he is appraised as a sharecropper, but the produce he takes entirely (Tur in the name of the Ri and the Rosh). And if it was heard that he had died before they put him in, and afterwards they came, he has nothing in the improvement; rather, what he ate he has eaten, and what he spent he has spent (there, in the name of the Rosh). And why do they not appoint a guardian for all time, whether over the movables or over the lands, until the owners come or until it is known for certain that they have died? Because the court is not obliged to appoint a guardian for adults, who are persons of understanding. Hagah [Rema]: However, if there were someone here who wishes to be a guardian for the benefit of the captive, they appoint him, and there is no greater benefit than this. However, the heir can protest against appointing a guardian (Tur in the name of the Rosh, and Nimukei Yosef, chapter "One who deposits"); and some say that the heir cannot protest (the Maggid, chapter 7 of the Laws of Inheritance, and Mordechai, chapter "One who deposits"). One who is not of sound mind — his law is as a minor's, and they appoint a guardian for him (Beit Yosef in the name of the Rashba).

נשבה השבוי וברח המסוכן והניח קמה לקצור וענבים לבצור תמרים לגדור וזיתים למסוק ב"ד יורדים לנכסיו ומעמידים להם אפוטרופוס וקוצר ובוצר וגודר ומוסק ומוכר הפירות ומניח דמיהם עם שאר המטלטלים בב"ד ואח"כ מורידין הקרוב לנכסי ושאם ירד תחלה שמא יתלוש אלו הפירות שהם כתלושים ויאכל אותם וה"ה בחצירות ופונדקאות חניות העשויות לשכר ואינם צריכים עבודה ולא טורח ואין אדם נותן אותם באריסות אין מורידין להם יורש שהרי גובה השכר ואוכל אלא כיצד עושין ב"ד מעמידין להם גבאי ויהיה השכר מונח בב"ד עד שיביא ראיה שמת או עד שיבא ויטול שלו ואין מורידין הקרוב לעולם אלא לשדות וגנות וכרמים וכיוצא בהם שיהיו בהם כאריס כדי שלא יפסדו ונמצאו בורים (פי' שוממים) ונשמים (פי' מענין והארץ הנשמה והם שמות נרדפים):

If the captive was taken captive, or the one in danger fled, and he left standing grain to be reaped, grapes to be gathered, dates to be cut and olives to be picked, the court goes down into his property and appoints a guardian for them, and he reaps, gathers, cuts and picks, and sells the produce, and deposits their price with the rest of the movables in the court; and afterwards they put the relative into the property. For if he went down first, perhaps he would pick this produce, which is as if already detached, and eat it. And the same is the law with courtyards, inns and shops that are made for rent and need no work and no trouble, and which a man does not give out in sharecropping: they do not put an heir into them, for he would collect the rent and eat it. Rather, how is it done? The court appoints a collector for them, and the rent lies in the court until he brings proof that he has died, or until he comes and takes what is his. And they never put the relative in except into fields, gardens, vineyards and the like, that he should be in them as a sharecropper, so that they are not spoiled and found fallow (that is, desolate) and waste (that is, from the sense of "and the desolate land"; and they are synonyms).
