Se’if 1א׳
אין צריך עדות ליורש שהוא קרוב וצריך עדות שמת. ובו ד סעיפים: הגה כל היורשין יורשין בחזקה שהעידו העדים שהוחזק להן שהוא פלוני אע"פ שאינן יודעין אמיתת יחוסו והוא הדין בשאר יורשין (טור) מי שהוא מוחזק באחד שהוא קרוב המת ואין אנו יודעין קרוב יותר ממנו הרי זה יורשו ולא חיישי' שמא יש קרוב יותר ממנו כל זמן שלא יודעין (הרא"ש כלל פ"ו סי' ט' ואגודה) ועיין לעיל סי' ר"פ סעיף ז' ולא מורידין קרוב לירושה על פי עד אחד (ריב"ש סי' מ"ו):
No testimony is needed for an heir that he is a relative, and testimony is needed that the one he inherits died; it contains four se'ifim. Hagah [Rema]: All heirs inherit by presumption, where witnesses testified that he is established to them as So-and-so, even though they do not know the truth of his lineage; and the same law applies to the other heirs (Tur). One who is presumed to be a relative of the deceased, and we do not know of a relative nearer than he — he inherits him, and we are not concerned lest there is a relative nearer than he, so long as we do not know (the Rosh, klal 86, siman 9, and Agudah). And see above, siman 280, se'if 7. And they do not bring a relative down into an inheritance on the word of one witness (Rivash, siman 46).
Se’if 2ב׳
אין היורשים נוחלים עד שיביאו ראיה שמת מורישן אבל אם שמעו בו שמת או שבאו עכו"ם מסיחים לפי תומם אע"פ שמשיאין את אשתו על פיהם [ ונוטלת את כתובתה] וכן האשה שבאה ואמרה מת בעלי אע"פ שהיא נאמנת ותנשא ותטול כתובתה אין היורשים נכנסים לנחלה על פיה:
Heirs do not take the inheritance until they bring proof that the one they inherit from has died. But if they heard of him that he had died, or gentiles came speaking in all innocence — even though they permit his wife to remarry on their word, and she takes her ketubah — and likewise a woman who came and said, "My husband has died" — even though she is believed and may remarry and take her ketubah, the heirs do not enter into the inheritance on her word.
Se’if 3ג׳
אמרה מת בעלי ונתיבמה הרי יבמה נכנס לנחלה על פיה שנאמר יקום על שם אחיו המת והרי קם:
If she said, "My husband has died", and entered levirate marriage, her yavam (the brother who took his dead brother's childless widow) enters into the inheritance on her word, as it is said, "shall succeed in the name of his brother who is dead" (Deuteronomy 25:6), and he has succeeded.
