דין ירושת עכו"ם וגר וישראל מומר לעכו"ם. ובו ג סעיפים: העכו"ם יורש את אביו דבר תורה והגר אינו יורש את אביו עכו"ם אלא מדבריהם תקנו לו שיירש כשהיה שמא יחזיר למרדו ותנאי מועיל בירושה זו הואיל ואין העכו"ם מחויב לעמוד בתקנת חכמים ולא העכו"ם יורש את אביו הגר ולא גר את גר לא מדברי תורה ולא מדברי סופרים אפי' היה לו בן שלידתו בקדושה מאחר שהורתו שלא בקדושה אינו יורש את אביו ולא אביו יורשו: הגה וישראל שהיה חייב לעכו"ם ומת אם אין עכו"ם יודעין מזה אינו חייב לפרוע ליורשיו (מרדכי פרק קמא דקידושין ):

The law of the inheritance of a gentile, a convert, and an Israelite who apostatised to idolatry; it contains three se'ifim. A gentile inherits his father by the word of the Torah; and a convert does not inherit his gentile father, except that by their words the Sages ordained that he should inherit as before, lest he return to his rebellion. And a condition is effective in this inheritance, since the gentile is not obliged to abide by an ordinance of the Sages. And neither does the gentile inherit his father the convert, nor a convert a convert, neither by the words of the Torah nor by the words of the Scribes; even if he had a son whose birth was in holiness, since his conception was not in holiness, he does not inherit his father, nor does his father inherit him. Hagah [Rema]: And an Israelite who owed a gentile and died — if the gentiles do not know of it, he is not obliged to pay the gentile's heirs (Mordechai, the first chapter of Kiddushin).

ישראל שהמיר לעכו"ם יורש את קרוביו הישראלים כשהיה ואם ראו ב"ד לאבד את ממונו ולקנסו שלא יירש שלא לחזק ידי הרשעים הרשות בידם ואם יש להן בנים בישראל תנתן ירושת אביהם המומר להם: הגה ואפילו נתן המומר הנכסים לאחרים אין במתנתו כלום דמיד נפלו נכסיו קמי יורשיו ואין לו כח בהן וי"א שמניחין הירושה בב"ד ואם יחזור בתשובה נותנין לו (הכל בטור ס"ה בשם תשובת הרא"ש) וישראל יורש קרובי המומר לעכו"ם (טור ס"ד בשם הרא"ש) אפילו הפקיד הממון ביד ישראלים אחרים ואפי' היו לו בנים בגיותו אבל אם הנפקדים שלחו יד בממון הפקדון בחיי המומר או שבקש הממון ולא רצו ליתנו לו ויש להן עדים על זה זכו במה שבידן ואין יורשיו יכולין להוציא מיד הנפקד הן בחיי המומר הן לאחר מותו דכל המוחזק בנכסיו יכול לזכות בהן כל זמן שהוא חי (מרדכי פ"ק דקידושין בשם רש"י) ישראל מומר שמתה לו אמו ויש לו קרובים מן האב אם המומר גדול שראוי לקנסו בירושתו גם יורשיו אינן יורשין ונשארה הירושה כשאר יורשי האם אם המומר קטן שאינו ראוי לקנוס יורשיו יורשין אמו ובעל יורש במקום אשתו המומרת אע"פ שמת אביה לאחר שהמירה לעכו"ם ומתה אח"כ הבעל יורש מאחר דידו כידה אין שייך קנס (מרדכי פ' הנ"ל ות"ה סי' שמ"ט):

An Israelite who apostatised to idolatry inherits his Israelite relatives as before. And if the court saw fit to forfeit his money and to fine him so that he does not inherit, so as not to strengthen the hands of the wicked, the authority is theirs; and if they have sons in Israel, the inheritance of their apostate father is given to them. Hagah [Rema]: And even if the apostate gave the property to others, there is nothing in his gift, for his property fell at once before his heirs, and he has no power over it. And some say that they leave the inheritance with the court, and if he repents they give it to him (all this is in the Tur, se'if 5, in the name of a responsum of the Rosh). And an Israelite inherits his relative who is an apostate to idolatry (Tur, se'if 4, in the name of the Rosh), even if the apostate deposited the money in the hands of other Israelites, and even if he had sons in his gentile state. But if the bailees put forth a hand to the money of the deposit in the apostate's lifetime, or he asked for the money and they did not want to give it to him, and they have witnesses to this, they have acquired what is in their hand, and his heirs cannot take it out of the bailee's hand, whether in the apostate's lifetime or after his death; for whoever holds his property may acquire it so long as he is alive (Mordechai, the first chapter of Kiddushin, in the name of Rashi). An Israelite apostate whose mother died, and he has relatives on the father's side: if the apostate is an adult, fit to be fined in his inheritance, his heirs too do not inherit, and the inheritance remains with the other heirs of the mother; if the apostate is a minor, not fit to be fined, his heirs inherit his mother. And a husband inherits in the place of his apostate wife, even though her father died after she apostatised to idolatry and she died afterwards — the husband inherits; since his hand is as her hand, the fine does not apply (Mordechai, the chapter mentioned, and Terumat haDeshen, siman 349).

לאה נשבית ואמה קבצה מעות לפדיונה ואח"כ שמעה שהמירה ונטמעה בין העכו"ם אם א"א להחזיר לכל אחד מה שנתן יהיה הקרן קיים לפדיון שבוים ואם יתכן לפדות באחרית הימים אותה שבויה תפדה בהם (וע' בי"ד סי' רנ"ג סעיף ו'):

Leah was taken captive, and her mother collected money for her ransom, and afterwards she heard that she had apostatised and been swallowed up among the gentiles: if it is impossible to return to each one what he gave, the principal shall stand for the redemption of captives; and if it becomes possible in later days to redeem that captive, she is redeemed with it (and see Yoreh De'ah, siman 253, se'if 6).
