המעביר נכסיו מבניו ליתנם לאחד. ובו י סעיפים: אין אדם יכול להוריש מי שאינו ראוי ליורש ולא לעקור הירושה מהיורש בין שצוה והוא בריא בין שהיה שכיב מרע בין על פה בין בכתב לפיכך האומר איש פלוני בכורי לא יטול פי שנים איש פלוני בני לא יירש עם אחיו לא אמר כלום איש פלוני יירשני במקום שיש לו בת בתי תירשני במקום שיש לו בן לא אמר כלום וכן כל כיוצא בזה אבל אם היו לו יורשים רבים כגון בנים רבים או אחים או בנות ואמר כשהוא שכ"מ פלוני אחי יירשני מכלל אחי או בתי פלונית ירשני מכלל בנותי (או שריבה לאחד ומיעט לאחד (טור) דבריו קיימים בין שאמר ע"פ בין שאמר בכתב אבל אם אמר פלוני בני ירשני לבדו אם אמר ע"פ דבריו קיימים אבל אם כתב כל נכסיו לבנו לא עשאו אלא אפוטרופוס כמו שנתבאר בסי' רמ"ו:

One who transfers his property from his sons to give it to one; it contains ten se'ifim. A man cannot make one who is not fit to inherit him his heir, nor uproot the inheritance from the heir, whether he commanded it when healthy or when he was dangerously ill, whether by word of mouth or in writing. Therefore, one who says, "So-and-so my firstborn shall not take a double portion", or "So-and-so my son shall not inherit with his brothers", has said nothing. "So-and-so shall inherit me", where he has a daughter; "My daughter shall inherit me", where he has a son — he has said nothing; and likewise every similar case. But if he had many heirs, such as many sons, or brothers, or daughters, and he said, when he was a person dangerously ill, "So-and-so my brother shall inherit me", from among his brothers, or "My daughter So-and-so shall inherit me", from among his daughters (or he gave more to one and less to another) (Tur) — his words stand, whether he said it by word of mouth or in writing. But if he said, "So-and-so my son shall inherit me alone" — if he said it by word of mouth, his words stand; but if he wrote all his property to his son, he made him only a guardian, as explained in siman 246.

Se’if 2ב׳

אמר פלוני בני יירש חצי נכסי ושאר בני החצי דבריו קיימים:

If he said, "So-and-so my son shall inherit half my property, and my other sons the half", his words stand.

Se’if 3ג׳

אמר פלוני בני לא יירש אלא כך וכך או שאמר ראובן בני יירש חלקו וחלק שמעון או שאמר לא יירש שמעון אלא ראובן לא אמר כלום אבל אם אמר ראובן בני יירשני או יירש כל נכסי ולא יירש שמעון דבריו קיימים: הגה וכן אם אמר לא יירש שמעון וראובן יירש הכל דבריו קיימים (המגיד פ' י' דנחלות ):

If he said, "So-and-so my son shall inherit only such-and-such", or he said, "Reuven my son shall inherit his share and Shimon's share", or he said, "Shimon shall not inherit, but Reuven" — he has said nothing. But if he said, "Reuven my son shall inherit me", or "shall inherit all my property, and Shimon shall not inherit", his words stand. Hagah [Rema]: And likewise if he said, "Shimon shall not inherit, and Reuven shall inherit all", his words stand (the Maggid, chapter 10 of the Laws of Inheritance).
