Se’if 1א׳
אמר אחד זה אחינו או שבא אחד ואמר אני אחיך. ובו יב סעיפים: כל היורשים יורשין בחזקתן כיצד עדים שהעידו שזה מוחזק לנו שהוא בנו של פלוני או אחיו אע"פ שאינם עידי ייחוס ולא ידעו אמיתת היחוסים הרי אלו יורשים בעדות זו:
One who said, "This is our brother", or where one came and said, "I am your brother"; it contains twelve se'ifim. All heirs inherit by their presumption. How so? Witnesses who testified that this one is presumed by us to be the son of So-and-so, or his brother — even though they are not witnesses of lineage and did not know the truth of the lineage, these inherit by this testimony.

יעקב שמת והניח ראובן ושמעון ולא הוחזק לו בן אלא שניהם תפס ראובן לוי מהשוק ואמר גם זה אחינו הוא ושמעון אומר איני יודע הרי שמעון נוטל חצי הממון וראובן שליש שהרי הודה שהם שלשה אחים ולוי נוטל שתות מת לוי יחזיר השתות לראובן נפל ללוי נכסים אחרים יחלקו אותם ראובן ושמעון שהרי ראובן מודה לשמעון שלוי זה אחיהם: הגה וכל זמן שהנכסים שלוי לקח מראובן הן בעין או שאר נכסים הבאין מחמתן נוטל ראובן בראש אבל אי ליתנהו להני נכסים ולא הבא מחמתן אין ראובן נוטל כלום בראש אלא חולק עם שמעון בשוה (טור בשם הרמ"ה):
Yaakov died and left Reuven and Shimon, and no son of his was known but the two of them. Reuven took hold of Levi from the market and said, "This one too is our brother", and Shimon says, "I do not know" — Shimon takes half the money, and Reuven a third, for he admitted that they are three brothers, and Levi takes a sixth. If Levi died, the sixth goes back to Reuven. If other property fell to Levi, Reuven and Shimon divide it, for Reuven concedes to Shimon that this Levi is their brother. Hagah [Rema]: And so long as the property that Levi took from Reuven is intact, or other property that came by reason of it, Reuven takes it first; but if that property is not in existence, nor what came by reason of it, Reuven takes nothing first, but divides with Shimon equally (Tur in the name of the Ramah).
Se’if 3ג׳
השביח השתות מאליו ואח"כ מת לוי אם שבח המגיע לכתפי' הוא כגון ענבי' שהגיעו להבצר הרי השבח זה כנכסים שנפלו מאחרים ויחלוקו בהם ואם עדיין לא הגיעו להבצר הרי הם של ראובן לבדו:
If the sixth improved of itself and afterwards Levi died: if it is an improvement that has come to be carried on the shoulders, such as grapes that have become ready to be harvested, this improvement is as property that fell to him from others, and they divide it; and if they had not yet become ready to be harvested, they are Reuven's alone.
