Se’if 1א׳
דין האומר זה בני או אחי או עבדי וחזר ואמר איפכא. ובו ו סעיפים: האומר זה בני וזה אחי או זה אחי אבי או שאר היורשים אותי אע"פ שהודה באנשים שאינם מוחזקים שהם קרוביו ה"ז נאמן ויירשנו בין שאמר כשהוא בריא בין שאמר כשהוא שכיב מרע אפי' נשתתק וכתב בכתב ידו שזה יורשו בודקים אותו כדרך שבודקין לגיטין: הגה ונאמן על כל נכסים בין אלו שהיו לו בשעה שאומר כך אפילו נכסים שיפלו לו כשהוא גוסס (טור בשם הרא"ש):
The law of one who says, "This is my son", or "my brother", or "my slave", and then said the reverse; it contains six se'ifim. One who says, "This is my son", or "This is my brother", or "This is my father's brother", or of the other heirs, "He inherits me" — even though he admitted concerning people who are not presumed to be his relatives, he is believed, and the one named inherits him; whether he said it when he was healthy or said it when he was dangerously ill. Even if he became mute and wrote in his own handwriting that this one is his heir, they examine him in the way they examine for bills of divorce. Hagah [Rema]: And he is believed concerning all the property — both what he had at the time he said so, and even property that falls to him when he is a goses (one in the throes of death) (Tur in the name of the Rosh).
Se’if 2ב׳
היינו מוחזקין בזה שהוא אחיו או בן דודו ואמר אינו אחי ואינו בן דודי אינו נאמן אבל נאמן הוא על מי שהוחזק שהוא בנו לומר אינו בני ולא יירשנו ואפי' היו לבן בנים אע"פ שאינו נאמן עליו לומר אינו בני לענין יחוס ואין מחזיקין אותו ממזר על פיו נאמן הוא לענין ירושה ולא יירשנו: הגה ואם מת הבן ואמר על בני בניו אין אלו בני בני כי לא היה אביהן בני אינו נאמן אף על הירושה מאחר שאין בנו קיים (המגיד פרק ד' דנחלות):
If this one was presumed by us to be his brother or his uncle's son, and he said, "He is not my brother", or "He is not my uncle's son", he is not believed. But he is believed concerning one who was established as his son, to say, "He is not my son", and he does not inherit him. And even if the son had sons — although he is not believed about him, to say "He is not my son", as regards lineage, and they do not hold him a mamzer (one born of a forbidden union) on his word — he is believed as regards inheritance, and the son does not inherit him. Hagah [Rema]: And if the son died, and he said of his son's sons, "These are not my son's sons, for their father was not my son", he is not believed even as to the inheritance, since his son is not alive (the Maggid, chapter 4 of the Laws of Inheritance).
Se’if 3ג׳
האומר זה בני וחזר ואמר עבדי הוא אינו נאמן אמר עבדי וחזר ואמר בני אע"פ שהוא משמשו כעבד נאמן שזה שאמר עבדי לומר שהוא לו כעבד ואם היו קורים לו עבד בן אמה וכיוצא בדברים אלו שאין אומרים אותם בייחוד אלא לעבדים אינו נאמן:
One who says, "This is my son", and then said, "He is my slave", is not believed. If he said, "My slave", and then said, "My son", even though he serves him as a slave, he is believed; for when he said "my slave", he meant that he is to him as a slave. But if they used to call him "slave, son of a maidservant", and similar things that are said specifically only of slaves, he is not believed.
