Se’if 1א׳
סדר נחלות כיצד הוא. ובו ז סעיפים: סדר נחלות כך מי שמת בנו יורשו לא נמצא (לו) בן רואים אם יש לבן זרע בין זכר בין נקיבה עד סוף כל הדורות עומד במקומו ויורש הכל לא נמצא זרע לבן אם יש לו בת תירשנו לא נמצא לו בת אם יש לה זרע בין זכר בין נקיבה עד סוף כל הדורות יורש הכל לא נמצא לה זרע תחזיר הירושה לאביו של מת ואם אין אביו קיים תחזור לזרעו שהם אחי המת אם יש לו אח יורש הכל לא נמצא לו אח אם הניח זרע עד סוף כל הדורות עומד במקומו לירש לא נמצא לו אח ולא זרע ממנו תחזור הירושה לאחות המת או לזרעה עד סוף כל הדורות לא נמצא אחות ולא זרע ממנה תחזור הירושה לאבי אביו של מת ואם אינו קיים חוזר לזרעו שהם אחי אבי המת אם יש לו אחים או לזרעם עד סוף כל הדורות ואם אין אחים לאבי המת ולא זרע מהם חוזרות לאחות אבי המת או לזרעה עד סוף כל הדורות ואם אין אחות לאבי המת ולא זרע ממנה חוזרת לאבי אבי אביו של מת ואם אינו חי מורישו לזרעו שהם אחי אבי אביו של מת או לזרעם עד סוף כל הדורות לא נמצאו אחי אבי אביו של מת ולא זרעם חוזרות לאחות אבי אביו של מת או לזרעה עד סוף כל הדורות ועל זה הדרך נחלה ממשמשת למעלה עד ראובן:
The order of inheritances, how it is; it contains seven se'ifim. The order of inheritances is thus: one who died — his son inherits him. If no son was found (to him), they see whether the son has offspring, whether male or female, to the end of all generations: it stands in his place and inherits all. If no offspring of the son was found, then if he has a daughter, she inherits him. If no daughter was found to him, then if she has offspring, whether male or female, to the end of all generations, it inherits all. If no offspring of hers was found, the inheritance goes back to the father of the deceased; and if his father is not living, it goes back to his offspring, who are the brothers of the deceased: if he has a brother, he inherits all; if no brother was found to him, then if the brother left offspring, to the end of all generations, it stands in his place to inherit. If there was found neither a brother nor offspring of his, the inheritance goes back to the sister of the deceased or to her offspring, to the end of all generations. If there was found neither a sister nor offspring of hers, the inheritance goes back to the father of the deceased's father; and if he is not living, it goes back to his offspring, who are the brothers of the deceased's father, if he has brothers, or to their offspring, to the end of all generations. And if the deceased's father has no brothers and no offspring of theirs, it goes back to the sister of the deceased's father or to her offspring, to the end of all generations. And if the deceased's father has no sister and no offspring of hers, it goes back to the father of the father of the deceased's father; and if he is not alive, he passes it to his offspring, who are the brothers of the deceased's father's father, or to their offspring, to the end of all generations. If there were found no brothers of the deceased's father's father and no offspring of theirs, it goes back to the sister of the deceased's father's father or to her offspring, to the end of all generations. And in this way the inheritance reaches upwards as far as Reuven.
Se’if 2ב׳
מי שמת והניח בת ובת הבן אפי' בת בת בת הבן עד סוף כמה דורות היא קודמת ותירש הכל ואין לבת כלום וה"ה לבת האח עם האחות ולבת בן אחי אביו עם אחות אביו וכן כל כיוצא בזה:
One who died and left a daughter and a son's daughter — even a son's daughter's daughter's daughter, to the end of several generations — she takes precedence and inherits all, and the daughter has nothing. And the same law applies to the brother's daughter with the sister, and to the daughter of the son of his father's brother with his father's sister, and likewise every similar case.
Se’if 3ג׳
מי שהיו לו שני בנים ומתו שניהם בחייו והניח האחד שלשה בנים והשני לא הניח אלא בת אחת ואח"כ מת הזקן בת הבן יורשת חצי הנכסים ושלשת בני הבן האחר יורשים החצי האחר שאנו רואים כאילו הבנים קיימים ויורשים בשוה וכל אחד מוריש לבניו חלקו ועל דרך זה חולקים בני האחים ובני אחי האב עד ראש הדורות:
One who had two sons, and both of them died in his lifetime, and the one left three sons and the second left only one daughter, and afterwards the old man died — the son's daughter inherits half the property, and the three sons of the other son inherit the other half; for we regard it as though the sons were alive and inheriting equally, and each one passes his share to his children. And in this way the brothers' children and the children of the father's brothers divide, up to the head of the generations.
