עכו"ם שמכר שדה לישראל וקבל הדמים ולא כתב לו השטר הרי הוא כהפקר וכל הקודם בהם זכה ונתבאר בסימן קצ"ד: הגה עשרה תנאים התנה יהושע בארץ וכולן נוהגות אף בחוץ לארץ וכתבן הרמב"ם פ"ה דהלכות נזקי ממון והטור סי' רע"ד א' ולא ידעתי למה השמיטן המחבר הזה ואולי משום שאינן שכיחין שרובם אינן רק במקום שיש לישראל שדות וכרמים וזה אינו שכיח בגלות והרוצה לעמוד על דיניהן יעיין בפנים מי שהיה לו נחיל של דבורים ויצאו וישבו על אילן של חבירו י"א דיכול לקוץ ענף כדי להציל נחילו ונותן דמי ענף לבעל האילן (טור בשם אביו הרא"ש) ויש חולקין (שם בשם הרי"ף והרמ"ה):
A gentile who sold a field to an Israelite and received the money, and did not write him the document — it is as ownerless, and whoever comes first to it acquires; and it has been explained in siman 194. Hagah [Rema]: Joshua stipulated ten conditions in the Land, and all of them apply even outside the Land; and the Rambam wrote them in chapter 5 of the Laws of Damage to Property, and the Tur in siman 274, se'if 1; and I do not know why this author omitted them — perhaps because they are not common, for most of them apply only in a place where Israelites have fields and vineyards, and this is not common in the exile; and whoever wishes to understand their laws should look into them there. One who had a swarm of bees, and they went out and settled on his fellow's tree — some say that he may cut off a branch to rescue his swarm, and he gives the value of the branch to the owner of the tree (Tur in the name of his father, the Rosh); and some disagree (there, in the name of the Rif and the Ramah).
