Se’if 1א׳

דין הזוכה מן ההפקר והפקר כיצד וכמה. ובו יח סעיפים: כל דבר של הפקר כל הקודם בו זכה בין שהוא דבר מופקר ועומד בין שהיו לו בעלים והפקירוהו:

The law of one who acquires from ownerless property, and ownerless property — how, and how much; it contains eighteen se'ifim. Anything ownerless — whoever comes first to it acquires it, whether it is a thing that has always stood ownerless or it had owners and they declared it ownerless.

Se’if 2ב׳

ההפקר אע"פ שאינו נדר הרי הוא כמו נדר שאסור לחזור בו:

A declaration of ownerlessness, although it is not a vow, is like a vow, in that it is forbidden to retract from it.

Se’if 3ג׳

ומה הוא ההפקר שיאמר אדם נכסי אלו הפקר לכל בין במטלטלים בין בקרקעות:

And what is a declaration of ownerlessness? That a man says, "These properties of mine are ownerless to all", whether movables or land.
