Siman 272 of 427 in Choshen Mishpat — 18 se'ifim

Loading and unloading· siman 272

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

The law of animals or ships that met one another; it contains eighteen se'ifim. One who met his fellow on the road, and his animal was lying under its burden — whether it carried a burden fitting for it or it carried more than its burden — it is a mitzvah to unload it, as it is said, "you shall surely release it with him" (Exodus 23:5) (if it was the animal's way always to lie down under its burden, or it is standing under its burden, he is not obliged) (Tur, se'if 5). And he should not unload and leave him in distress and go; rather he lifts it with him and loads his burden onto it again, as it is said, "you shall surely help him lift them up" (Deuteronomy 22:4). And if he left him in distress and neither unloaded nor loaded, he has neglected a positive commandment and transgressed a negative commandment, as it is said, "You shall not see your brother's donkey" (Deuteronomy 22:4).

Se’if 2ב׳

If he was a priest and the animal was lying among the graves, he does not defile himself for it.

Se’if 3ג׳

And likewise if he was an elder whose way is not to unload and load, since it is not in keeping with his dignity he is exempt (Tur, se'if 8). This is the rule: whatever, were it his own, he would unload and load, he is obliged to load and unload in his fellow's. And if he was a pious man who acts beyond the strict line of the law — even if he was the great Nasi and saw his fellow's animal lying under its burden of straw or of reeds and the like — he unloads and loads with him (and some disagree in this, as explained above at the end of siman 263) (Tur, se'if 9, in the name of the Rosh).

…and 13 more se'ifim in this siman.
