מציאת חרש שוטה וקטן ובנו ובתו ועבדו ושפחתו ואשתו ופועלו. ובו ג סעיפים: מציאת חרש שוטה וקטן אין בה משום גזל אלא מפני דרכי שלום לפיכך אם עבר א' וגזלה מידם אינה יוצאה בדיינים: הגה ודוקא מציאה שאין דעת אחרת מקנה לו אבל שכירות של קטן וכיוצא בו מוציאין בדיינין (ב"י בשם הרשב"א):

The find of a deaf-mute, one who is not of sound mind and a minor, and of his son and his daughter, his slave and his maidservant, his wife and his worker; it contains three se'ifim. The find of a deaf-mute, one who is not of sound mind or a minor — there is no robbery in it except because of the ways of peace; therefore, if one transgressed and robbed it from their hand, it is not recoverable through judges. Hagah [Rema]: And this is specifically a find, which no other mind transfers to him; but the hire of a minor and the like is recovered through judges (Beit Yosef in the name of the Rashba).

מציאת בנו ובתו הסמוכים על שולחנו אע"פ שהם גדולים ומציאת בתוהנערה אע"פ שאינה סומכת על שולחנו ומציאת עבדו ושפחתו הכנענים ומציאת אשתו הרי אלו שלו (וה"ה אם הרויחו בסחורה או במלאכה (ב"י ססי' קע"ז בשם עיטור) אבל אם מת אינו מוריש מלאכת בן אחד לשאר ורשיו) (הגהות שניות דמרדכי דב"מ) אבל מציאת בנו שאינו סומך על שולחנו אע"פ שהוא קטן ומציאת עבדו ושפחתו העברים ומציאת אשתו שהיא מגורשת ואינה מגורשת אינה שלו ואם נתנו מתנה לקטן הסומך על שולחן אביו הרי היא של אביו אבל לא בבנו הגדול (נ"י פ"ק דמציעא) יתום הסמוך על שלחן אחרים מציאתו לעצמו (מרדכי ותוס' פ"ק דמציעא):

The find of his son and his daughter who are dependent on his table, even though they are adults, and the find of his daughter who is a na'arah (a girl between twelve years and twelve and a half), even though she is not dependent on his table, and the find of his Canaanite slave and maidservant, and the find of his wife — these are his (and the same law applies if they profited in trade or in work) (Beit Yosef, end of siman 177, in the name of the Ittur) (but if he died, he does not bequeath the work of one son to the rest of his heirs) (Hagahot Sheniyot of the Mordechai on Bava Metzia). But the find of his son who is not dependent on his table, even though he is a minor, and the find of his Hebrew slave and maidservant, and the find of his wife who is divorced and not divorced, are not his. And if they gave a gift to a minor who is dependent on his father's table, it belongs to his father, but not with his adult son (Nimukei Yosef, the first chapter of Bava Metzia). An orphan who is dependent on the table of others — his find is his own (Mordechai and the Tosafot, the first chapter of Bava Metzia).

מציאת פועל לעצמו אע"פ שאמר לו עשה עמי מלאכה היום ואצ"ל אם א"ל עדור עמי היום אבל אם שכרו ללקט מציאות כגון שחסר הנהר ושכרו ללקט הדגים הנמצאים באגם הרי מציאותו לב"ה ואפי' מצא כיס מלא דינרים ויש אומרים דהוא הדין שכרו סתם ומראה לו ללקט מציאות (טור בשם הרמ"ה):

The find of a worker belongs to himself, even though the employer said to him, "Do work with me today"; and it need not be said if he said to him, "Hoe with me today". But if he hired him to gather finds — for example, the river diminished and he hired him to gather the fish that are found in the pool — his finds belong to the householder, and even if he found a purse full of dinars. And some say that the same law applies if he hired him without specifying and showed him to gather finds (Tur in the name of the Ramah).
