Se’if 1א׳

דין אבידת עוברי עבירה. ובו ה סעיפים: אבידת העכו"ם מותרת שנא' אבידת אחיך והמחזירה ה"ז עובר עבירה מפני שהוא מחזיק ידי עוברי עבירה ואם החזירה לקדש את השם כדי שיפארו את ישראל וידעו שהם בעלי אמונה ה"ז משובח ובמקום שיש חילול השם אבידתו אסורה וחייב להחזירה ובכל מקום מכניסים כליהם ככלי ישראל מפני דרכי שלום:

The law of the lost object of transgressors; it contains five se'ifim. The lost object of a gentile is permitted, as it is said, "the lost object of your brother" (Deuteronomy 22:3); and one who returns it commits a transgression, because he strengthens the hands of transgressors. And if he returned it to sanctify the Name, so that they should glorify Israel and know that they are people of faith, this is praiseworthy. And in a place where there is desecration of the Name, his lost object is forbidden, and he is obliged to return it. And in every place they gather in their articles as the articles of Israelites, because of the ways of peace.

Se’if 2ב׳

חייב להחזיר אבידת ישראל אפי' היה בעל האבידה רשע ואוכל נבילה לתיאבון אבל אוכל נבילה להכעיס הרי הוא אפיקורוס מישראל והאפיקורסים ועובדי עבודת עכו"ם וישראל מחללי שבת בפרהסיא אסור להחזיר להם אבידה כעכו"ם:

He is obliged to return the lost object of an Israelite even if the owner of the lost object was wicked and eats carrion to satisfy his appetite. But one who eats carrion out of spite is an apikoros (one who has broken away from the teaching of the Sages) among Israel; and the apikorsim, and those who worship idols, and Israelites who desecrate the Sabbath in public — it is forbidden to return a lost object to them, as to a gentile.
