Se’if 1א׳

אבידתו קודמת לכל אדם אבידת רבו ואבידת אביו של מי קודמת. ובו ח סעיפים: מי שאבדה לו אבידה ופגע באבידתו ובאבידת חבירו אם יכול לחזור את שתיהן חייב להחזירם ואם לא יחזיר את שלו שאבידתו קודמת אפי' לאבידת אביו ורבו כדדרשינן מאפס לא יהיה בך אביון ואעפ"כ יש לו לאדם ליכנס לפנים משורת הדין ולא לדקדק ולומר שלי קודם אם לא בהפסד מוכח ואם תמיד מדקדק פורק ממנו עול גמילות חסדים וסוף שיצטרך לבריות:

His own lost object takes precedence over that of every man; the lost object of his teacher and the lost object of his father — whose takes precedence; it contains eight se'ifim. One who lost a lost object and came upon his own lost object and his fellow's lost object: if he can bring back both of them, he is obliged to return them; and if not, he brings back his own, for his own lost object takes precedence even over the lost object of his father and his teacher, as we expound from "only there shall be no poor among you" (Deuteronomy 15:4). And even so, a man ought to go beyond the strict line of the law and not be exacting and say, "Mine comes first", unless it is a case of evident loss; and if he is always exacting, he casts off from himself the yoke of acts of kindness, and in the end he will come to depend on other people.

Se’if 2ב׳

פגע באבידת אביו ובאבידת רבו אם היה אביו שקול כנגד רבו של אביו קודמת ואם לאו של רבו קודמת והוא שיהיה רבו מובהק שרוב חכמתו של תורה למד ממנו (ועבי"ד סי' רמ"ב סל"ד):

If he came upon the lost object of his father and the lost object of his teacher: if his father was the equal of his teacher, his father's takes precedence; and if not, his teacher's takes precedence. And this is where he is his principal teacher, from whom he learned most of his wisdom of the Torah (and see Yoreh De'ah, siman 242, se'if 34).

Se’if 3ג׳

הניח אבידתו והחזיר אבידת חבירו אין לו אלא שכר הראוי לו כיצד שטף נהר חמורו וחמור חבירו שלו שוה מנה ושל חבירו ק"ק הניח שלו והציל של חבירו אין לו אלא שכר הראוי לו ואם אמר לו אציל את שלך ואתה נותן דמי שלי או שהתנה כן בפני ב"ד חייב ליתן לו דמי שלו ואע"פ שעלה חמורו מאיליו זכה במה שהתנה עמו: הגה מיהו הוא הפקר וכל הקודם בו זכה (נ"י פרק הגוזל בתרא) ואם אין הבעלים שם אע"פ שלא התנה כאילו התנה דמי (טור) ועיין לקמן סי' רס"ה:

If he left his own lost object and returned his fellow's lost object, he has only the wage due to him. How so? If a river swept away his donkey and his fellow's donkey, his own worth a maneh and his fellow's two hundred, and he left his own and rescued his fellow's, he has only the wage due to him. But if he said to him, "I will rescue yours, and you give me the value of mine", or he stipulated so before a court, the other is obliged to give him the value of his own; and even though his donkey came up of itself, he has acquired what he stipulated with him. Hagah [Rema]: However, his own is ownerless, and whoever comes first to it acquires it (Nimukei Yosef, chapter "One who robs, the latter"). And if the owner is not there, even though he did not stipulate, it is as though he had stipulated (Tur). And see below, siman 265.
