Se’if 1א׳
המוצא אבידה שמתבייש להשיבה. ובו ג סעיפים: מצא שק או קופה אם היה חכם או זקן מכובד שאין דרכו ליטול כלים אלו בידו אינו חייב ליטפל בהם ואומד דעתו אילו היו שלו אם היה מחזירן לעצמו כך חייב להחזיר של חבירו ואם לא היה מוחל על כבודו אפי' היו שלו כך בשל חבירו אינו חייב להחזיר:
One who finds a lost object that he is ashamed to return; it contains three se'ifim. If he found a sack or a basket: if he was a sage or an honoured elder, whose way is not to take such articles in his hand, he is not obliged to trouble himself with them. And he assesses his own mind: if, were they his own, he would bring them back for himself, so he is obliged to return his fellow's; and if he would not forgo his dignity even were they his own, so with his fellow's he is not obliged to return it.
Se’if 2ב׳
היה דרכו להחזיר כלים כאלו בשדה ואין דרכו להחזירן בעיר ומצאן בעיר אינו חייב להחזיר מצאם בשדה חייב להחזיר עד שיגיעו לרשות הבעלים ואע"פ שהרי נכנס בהם לעיר ואין דרכו בכך (וי"א דלא יחזיר בעיר אלא יכניסה מן השדה לעיר ויניחנה) (טור בשם הרא"ש) וכן אם מצא בהמה והכישה נתחייב ליטפל בה ולהחזירה אע"פ שאינה לפי כבודו שהרי התחיל במצוה:
If his way was to bring back such articles in the field and his way was not to bring them back in the town, and he found them in the town, he is not obliged to return them. If he found them in the field, he is obliged to return them until they reach the owner's domain, even though he thereby enters the town with them and that is not his way (and some say that he should not return it in the town, but should bring it in from the field to the town and set it down) (Tur in the name of the Rosh). And likewise if he found an animal and struck it to drive it, he has become obliged to trouble himself with it and to return it, even though it is not in keeping with his dignity, for he has begun the mitzvah.
Se’if 3ג׳
ההולך בדרך הטוב והישר ועושה לפנים משורת הדין מחזיר את האבידה בכל מקום ואע"פ שאינה לפי כבודו: הגה ויש חולקין ואוסרין להחזיר הואיל ואינו לפי כבודו אלא אם רוצה ליכנס לפנים מן השורה ישלם מכיסו (טור בשם הרא"ש סי' רע"ב):
One who goes in the good and upright way and acts beyond the strict line of the law returns the lost object in every case, even though it is not in keeping with his dignity. Hagah [Rema]: And some disagree and forbid him to return it, since it is not in keeping with his dignity; rather, if he wishes to go beyond the line, he pays from his own purse (Tur in the name of the Rosh, siman 272).
