Se’if 1א׳

על איזה דבר חייב להכריז ואיזה דבר הוא של מוצאו. ובו כא סעיפים: כל אבידה שאינו שוה פרוטה בשעת אבידה ובשעת מציאה אינו חייב להכריז עליה אפי' היתה שוה פרוטה בשעת אבידה והוזלה או שלא היתה שוה פרוטה בשעת אבידה והוקרה אינו חייב אבל אם היתה שוה פרוטה בשעת אבידה ובשעת מציאה אפי' הוזלה באמצע חייב וכן אפי' הוזלה אחר מציא' חייב להכריז:

For what thing one is obliged to announce, and what thing belongs to its finder; it contains twenty-one se'ifim. Any lost object that is not worth a perutah (the smallest copper coin) at the time of the loss and at the time of the finding — he is not obliged to announce it. Even if it was worth a perutah at the time of the loss and became cheaper, or was not worth a perutah at the time of the loss and became dearer, he is not obliged. But if it was worth a perutah at the time of the loss and at the time of the finding, even if it became cheaper in the middle, he is obliged; and likewise, even if it became cheaper after the finding, he is obliged to announce it.

אפי' אבידה ששוה הרבה אם היא של שותפים הרבה שאין מגיע לכל אחד שוה פרוטה אינו חייב להחזירה בד"א שידוע שהם שותפים בה אבל בסתם שראה חפץ או מטבע שנפל משלשה ואינו שוה אלא שתי פרוטות חייב להחזיר דשמא שותפים הם בו ואחד מהם מחל חלקו לחבירו והרי יש בו שוה שתי פרוטות לשנים ואם אח"כ נודע שלא מחל א' לחבירו הרי הוא שלו אפי' בא לידו קודם שנודע ואם היה שוה פחות מב' פרוטות הרי הוא שלו דלא חיישינן דילמא שנים מחלו לאחד:

Even a lost object that is worth a great deal, if it belongs to many partners, so that there does not come to each one the worth of a perutah, he is not obliged to return it. When is this said? Where it is known that they are partners in it. But where it is unspecified — he saw an article or a coin fall from three people, and it is worth only two perutot — he is obliged to return it, for perhaps they are partners in it and one of them waived his share to his fellow, and so there is in it the worth of two perutot for two. And if afterwards it became known that none waived to his fellow, it is his, even though it came into his hand before it became known. And if it was worth less than two perutot, it is his, for we are not concerned lest two waived to one.

אין המוצא מציאה חייב להכריז אלא בדבר שיש בו סימן בגופו או שראוי ליתן סימן במקומו או בקשריו או במנינו או במדתו או במשקלו אבל אם אין בו שום סימן אפי' במקומו כגון שניכר שלא הונח שם בכוונה אלא דרך נפילה בא שם אם הוא דבר שיש לתלות שבעליו הרגישו בו מיד כשנפל ממנו או מחמת כובדו או מחמת חשיבותו ותמיד היה ממשמש בו ומרגיש כשנופל הרי הוא של מוצאו שהרי נתייאש מיד כשידע שנפל כיון שאין בו סימן ובא לידו בהיתר כיון שנתייאשו בעליו ואם לא צריך להחזיר אע"פ שנתייאש אח"כ כיון שבא לידו קודם יאוש:

One who finds a lost object is only obligated to announce something that has an identifying mark on itself, or when its location, its knots, its amount, its measurement or its weight is fitting to give as an identifying mark. But if it has no identifying mark, even in its location - such as if it is clear that it was not placed there intentionally, but rather came there in the manner of being dropped: If it something that can be assumed that its owners noticed very soon [after] it fell from them - either because of its heaviness or because of its significance and he is always feeling for it, so he notices when it falls - it is surely the finders. As behold, [the owner] abandoned [it] immediately when he knew that if fell, for it has no identifying mark. Hence it came to the hand of [the finder] permissibly, as its owners had abandoned it. But if [the object was] not [like this, the finder] is obligated to return it - even though [the owners] abandoned it afterwards - since it came to his hand before [its] abandonment.
