Se’if 1א׳

דין המוצא במקום שניכר שאינ' אבידה. ובו ד סעיפים: מצא חמור או פרה רועים בדרך ביום אין זה אבידה בלילה (או אם רואה חמור וכליו הפוכין) (טור) ה"ז אבידה בפנות היום ובנשף אם ראה אותם ג' ימים זה אחר זה הרי זו אבידה ונוטל ומכריז:

The law of one who finds in a place where it is evident that it is not a lost object; it contains four se'ifim. If he found a donkey or a cow grazing on the road by day, this is not a lost object; by night (or if he sees a donkey with its load overturned) (Tur), this is a lost object. If at dusk and at twilight he saw them three days one after the other, this is a lost object, and he takes it and announces it.

Se’if 2ב׳

ראה פרה רצה בדרך אם פניה כלפי העיר אין זו אבידה כלפי השדה ה"ז אבידה מצאה רועה בין הכרמים חייב להחזיר משום אבידת קרקע לפיכך אם היו הכרמים של עכו"ם אינה אבידה ואינו חייב להחזיר ואם חשש שמא יהרגנה העכו"ם כשימצאנה מפני שהפסידה הכרם ה"ז אבידה ונוטל ומכריז (וה"ה במקום שפורעין קנס מבהמות שרועים בשדות אחרים) (ר' ירוחם נ"ב):

If he saw a cow running on the road: if its face is towards the town, this is not a lost object; towards the field, this is a lost object. If he found it grazing among the vineyards, he is obliged to return it on account of the loss to land. Therefore, if the vineyards belonged to a gentile, it is not a lost object and he is not obliged to return it; but if he was concerned lest the gentile kill it when he finds it, because it damaged the vineyard, this is a lost object, and he takes it and announces it (and the same law applies in a place where they exact a fine for animals that graze in other people's fields) (Rabbeinu Yerucham, netiv 2).

Se’if 3ג׳

מצא פרה בר"ה אם עומדת בר"ה חייב להחזירו היתה רועה בעשבים או שהיתה ברפת שאינה משתמרת ואינה מאבדת לא יגע בה שאין זו אביד': הגה וי"א שאם הרפת חוץ לתחום חייב להחזירה (טור וכ"כ הרא"ש) מיהו נ"ל דהכל לפי הענין ואף הסברא הראשונה מודה אם היא בענין שאינה משומרת:

If he found a cow in the public domain: if it is standing in the public domain, he is obliged to return it. If it was grazing among the grasses, or it was in a stall where it is not guarded and yet it does not go astray, he should not touch it, for this is not a lost object. Hagah [Rema]: And some say that if the stall is outside the Sabbath limit, he is obliged to return it (Tur, and so wrote the Rosh). However, it seems to me that everything depends on the circumstances, and even the first view agrees where it is in a situation in which it is not guarded.
