Se’if 1א׳
השבת אבידה מאיזה מקום חייב להשיבה. ובו ט סעיפים: הרואה אבידת ישראל חייב לטפל בה להשיבה לבעליה שנאמר השב תשיבם ואם נטלה ע"מ לגזלה ועדיין לא נתייאשו הבעלים ממנה עובר משום השב תשיבם לאחיך ומשום לא תגזול ומשום לא תוכל להתעלם ואפי' אם יחזירנה אח"כ כבר עבר על לא תוכל להתעלם נטלה לפני יאוש על דעת להחזירה ולאחר ייאוש נתכוון לגזלה אינו עובר אלא משום השב תשיבם המתין עד אחר יאוש ונטלה אינו עובר אלא משום לא תוכל להתעלם:
The return of a lost object: from what place one is obliged to return it; it contains nine se'ifim. One who sees the lost object of an Israelite is obliged to take trouble with it to return it to its owners, as it is said: "you shall surely bring them back". And if he took it in order to rob it, and the owners have not yet despaired of it, he transgresses 'you shall surely bring them back to your brother', and 'you shall not rob', and 'you may not hide yourself'; and even if he returns it afterwards, he has already transgressed 'you may not hide yourself'. If he took it before despair with the intention of returning it, and after despair he intended to rob it, he transgresses only 'you shall surely bring them back'. If he waited until after despair and took it, he transgresses only 'you may not hide yourself'.
Se’if 2ב׳
בד"א במקום שהוא חייב להשיב משם ובמקום שראוי להסתפק בה באבידה ושתהא בענין שמוכח שהיא אבידה ושלא תהי' מדעת ושיהי' בה שוה פרוטה ושיש סי' בגופה או במקומ' ושהיה מטפל בה אם היתה שלו ושתהי' של מי שחייב להשיב אבידתו אבל אם חסר א' מכל אלו אינו חייב להשיב אבידתו:
In what case are these words said? In a place from which he is obliged to return it, and in a place where it may be taken for a lost object; and that it be in such a state that it is evident that it is a lost object; and that it not be lost knowingly; and that there be in it a perutah's worth; and that there be a identifying mark on its body or in its place; and that he would take trouble with it if it were his; and that it be of one whose lost object he is obliged to return. But if one of all these is lacking, he is not obliged to return his lost object.

כיצד המוציא מציאה במקום שישראל מצוים שם חייב להכריז שלא נתייאשו הבעלים ואפי' העיר מחצה עכו"ם ומחצה ישראל או אפי' רובה עכו"ם והוא מצאה במקום שרוב העוברים שם ישראל חייב להחזיר אבל אם רוב העיר עכו"ם או אפי' רובה ישראל ומצאה במקום שרוב העוברים שם עכו"ם אינו חייב אפי' אם ידע שמישראל נפלה ויש בה סי' שודאי נתייאשו הבעלים וכגון שהוא מדברים שיש לתלות שידע מיד בנפילתו וכמו שיתבאר: הגה וע"ל סי' רס"ב ס"ג וי"א דאם אבד ספרים לא מייאש מינייהו אפי' במקום שרובה עכו"ם (הגהות מרדכי דב"מ):
How? One who finds a find in a place where Israelites are frequent is obliged to announce it, for the owners have not despaired. And even if the city is half gentiles and half Israelites, or even mostly gentiles, and he found it in a place where most of those who pass there are Israelites, he is obliged to return it. But if most of the city is gentiles, or even if it is mostly Israelites and he found it in a place where most of those who pass there are gentiles, he is not obliged, even if he knew that it fell from an Israelite and it has a identifying mark, for the owners have certainly despaired; that is, where it is of the things of which one may presume that he knew at once of its falling, as will be explained. Hagah [Rema]: And see below, siman 262, se'if 3. And some say that if he lost books, he does not despair of them, even in a place that is mostly gentiles (Hagahot Mordechai on Bava Metzia).
