Siman 258 of 427 in Choshen Mishpat — 2 se'ifim

Deathbed Gifts· siman 258

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

A gift in which is written 'after death', if it has a date; it contains two se'ifim. A document of gift in which is written that so-and-so shall acquire such-and-such a field after death — whether there was a kinyan (a formal act of acquisition) in the document or there was no kinyan in it — since a date is written in it, and at this date he was alive, the date proves that he conveyed it to him in his lifetime, and he gains it only after death; for had it been in his mind to convey it to him by this document after death, he would not have written a date in it. Therefore, even though 'from today and after death' is not written in it, he acquires after death (and it is as though he wrote to him 'from today and after death', whose law was explained in siman 257). And this, that they write in all gifts and sales 'from now', even though there is a date in the document — to make the matter secure they (write) so, even though it is not needed.

Se’if 2ב׳

And likewise if there is a kinyan in it, he acquires the body at once, even if there is no date in it. Hagah [Rema]: For every kinyan is from now. And this that we say, the date of the document proves it, is where he writes to him 'after death'; but where he writes to him 'after thirty days', we do not say the date of the document proves it; and therefore if the giver or the recipient died within thirty days, the gift is void; and the same law applies, that the giver can retract within the thirty (Tur in the name of the Ramah). And this that we say, the date of the document proves it, is where the giver commanded to write a date, or commanded the witnesses to make a proper document; but a will in which a date was written only as a mere memorandum — we do not say the date of the document proves it (Beit Yosef in the name of the Rashba, and a responsum of the Ramban, siman 6, and Maharik, shoresh 94). And some say that it is not specifically the date of the document, but by word of mouth too the date proves it (the Ran, end of chapter "One who was seized").
