Se’if 1א׳
הכותב נכסיו לבנו או לאחר מהיום ולאחר מותו ומתנת בריא שכתבו בה מהיום ולאחר מיתה. ובו ז סעיפים: הכותב נכסיו לבנו לאחר מותו הרי הגוף של בן מזמן השטר והפירות לאב עד שימות לפיכך האב אינו יכול למכור מפני שהם נתונים לבן והבן אינו יכול למכור מפני שהם ברשות האב: הגה המקדיש קרקע מהיום ולאחר מותו או לאחר שלשים יום לא קדיש כלל דהא אי אפשר לומר גוף מהיום ופירות לאחר זמן דהא קא אכיל פירות של הקדש (תשו' רשב"א סי' תקס"ג) הכותב כל נכסיו לאחד מהיום ולאחר מיתה צריך למכרן ולקנות בדמיהן קרקע ולאכול מהן פירות כדין בעל בנכסי אשתו אלא א"כ התנה לעשות בנכסיו כל ימי חייו כפי מה שירצה (נ"י פרק י"נ):
One who writes his property to his son or to another, from today and after his death; and a healthy person's gift in which they wrote 'from today and after death'; it contains seven se'ifim. One who writes his property to his son after his death — the body is the son's from the date of the document, and the produce is the father's until he dies. Therefore the father cannot sell, because they are given to the son, and the son cannot sell, because they are in the father's domain. Hagah [Rema]: One who consecrates land from today and after his death, or after thirty days — it is not consecrated at all, for it is impossible to say: the body from today and the produce after a time, for he would be eating the produce of the sanctuary (a responsum of the Rashba, siman 563). One who writes all his property to one from today and after death must sell it and buy land with its price, and eat the produce of it, as the law of a husband with his wife's property, unless he stipulated to do with his property all the days of his life as he wishes (Nimukei Yosef, chapter "There are those who inherit").

מת האב והניח פירות המחוברים לקרקע הרי הן של בן מפני שדעתו של אדם קרובה אצל בנו היו תלושים או שהגיעו ליבצר הרי הם של יורשים: הגה מכר הבן כחו לאחר אין למקבל אפילו בפירות שלא הגיע זמנו לתלוש אלא הן של יורשי האב ונותנים לזה דמים כפי מה ששוין הפירות בשעה שמת או מניח הפירות בשדהו עד שיגמרו וכן הדין אם כ' הקרקע לאחר ולא לבנו (טור) אבל אם כתב לבן בנו הוי כאילו כתבה לבנו (ת"ה סי' ש"נ):
If the father died and left produce attached to the ground, it is the son's, because a man's mind is close to his son. If it was detached, or had come to the time of harvest, it is the heirs'. Hagah [Rema]: If the son sold his right to another, the recipient has nothing, even in produce whose time to be detached has not come; rather it is the father's heirs', and they give this one money according to what the produce is worth at the time that he died, or he leaves the produce in his field until it is ripe. And the same law applies if he wrote the land to another and not to his son (Tur). But if he wrote it to his son's son, it is as though he wrote it to his son (Terumat haDeshen, siman 350).

עבר האב ומכר מכורים (הפירות) עד שימות (ואפי' חזר ולקחה האב לא היה במכירתו כלום) (נ"י פרק יש נוחלין) וכשימות האב מוציא הבן (או יורשיו) (טור) מיד הלקוחות ואם היו שם פירות מחוברין שמין אותם ללוקח ונותן הבן דמיהם היו תלושים או שהגיעו ליבצר הרי הם של לוקח (וי"א שדין הבן עם הלוקח כמו עם האב) (טור וב"י בשם רשב"ם):
If the father transgressed and sold, they are sold (the produce) until he dies (and even if the father went back and bought it, there was nothing in his sale) (Nimukei Yosef, chapter "There are those who inherit"); and when the father dies, the son (or his heirs) (Tur) takes them out of the hand of the purchasers. And if there was attached produce there, they appraise it for the buyer, and the son pays its value; if it was detached, or had come to the time of harvest, it is the buyer's (and some say that the law of the son with the buyer is as with the father) (Tur, and Beit Yosef in the name of the Rashbam).
