Se’if 1א׳

שכיב מרע שאמר יש לי מנה ביד פלו' או של פלו' בידי. ובו ט סעיפים: ש"מ שאמר יש לי מנה ביד פלו' כותבין העדים כך וכך צוה פלו' אע"פ שאין יודעים אם אמת הוא אומר לפיכך כשבאים יורשיו לגבות צריכים להביא ראיה:

A person dangerously ill who said: I have a maneh in the hand of so-and-so, or: so-and-so's is in my hand; it contains nine se'ifim. A person dangerously ill who said: I have a maneh in the hand of so-and-so — the witnesses write: such-and-such did so-and-so command, even though they do not know whether he speaks the truth. Therefore, when his heirs come to collect, they must bring proof.

Se’if 2ב׳

שכ"מ שאמר מנה לפלו' בידי אם אמר תנו נותנים לא אמר תנו אין נותנין שמא לא אמר מנה יש לו לפלו' בידי אלא כדי שלא יאמרו על יורשיו שיש להם ממון לפיכך אם אמר זה דרך הודאה ולא היה שם חשש הערמ' נותני' אע"פ שלא אמר תנו וכן אם הודה בכתב ידו שכל נכסיו הם של פ' הויא הודאה ולא אמרי' בכי הא אדם עשוי שלא להשביע את בניו:

A person dangerously ill who said: so-and-so has a maneh in my hand — if he said 'give', they give; if he did not say 'give', they do not give, lest he said 'so-and-so has a maneh in my hand' only so that they should not say of his heirs that they have money. Therefore, if he said it by way of admission, and there was no concern of subterfuge there, they give, even though he did not say 'give'. And likewise if he admitted in his own handwriting that all his property is so-and-so's, it is an admission, and we do not say in such a case: a man is apt to act so as not to sate his sons.

המקדיש כל נכסיו אינו נאמן לומר אחר שהקדיש חוב לפלו' עלי או כלי זה של פלוני הוא שמא יעשו קנוניא על ההקדש ואפי' היה שטר ביד ב"ח אינו גובה ע"פ הודאתו אלא כדרך שגובה כל ב"ח בד"א בבריא אבל חולה שהקדיש כל נכסיו ואמר בשעה שהקדיש מנה לפלוני בידי נאמן שאין אדם עושה הערמה על ההקדש בשעת מיתתו וחוטא לאחרים שהרי הוא הולך למות לפיכך אם אמר תנו אותה נוטל בלא שבועה ואם לא אמר תנו אין נותנין אלא א"כ היה בידו שטר מקויים הרי זה נוטל מההקדש מפני הצוואה ואם אחר שהקדיש אמר תנו אין שומעין לו אלא הרי הוא כשאר בעלי חובות אם נתקיים שטרו נשבע וגובה מהפודה לא מההקדש:

One who consecrates all his property is not believed to say, after he consecrated: so-and-so has a debt against me, or: this article is so-and-so's — lest they make collusion against the sanctuary. And even if there was a document in the creditor's hand, he does not collect on his admission, but in the way that every creditor collects. In what case are these words said? With a healthy person. But a sick person who consecrated all his property, and said at the time that he consecrated: so-and-so has a maneh in my hand — he is believed, for a man does not practise subterfuge against the sanctuary at the time of his death and sin for the sake of others, for he is going to die. Therefore, if he said 'give it', he takes it without an oath; and if he did not say 'give', they do not give, unless he had in his hand a confirmed document — this one takes from the sanctuary because of the will. And if after he consecrated he said 'give', they do not listen to him, but he is as any other creditor: if his document has been confirmed, he swears and collects from the one who redeems, not from the sanctuary.
