ש"מ שביקש שיעשו קנין במתנות. ובו סעיף אחד: אע"פ שמתנת שכיב מרע אינה צריכה קנין אם ביקש שיקנו ממנו קונים אפי' בשבת שזה הקנין אינו צריך וי"א שאפי' אם יש נפקותא בקנין כגון שכותב כל נכסיו ומפרש שלא יחזור בו אם יעמוד קונים בשבת: הגה וי"א דאפי' מתנה במקצת דצריכה קנין אע"פ שנראה שאינו נותן מדאגת מיתה הואיל ואינו (נותן) כולם אפ"ה קונים ממנו בשבת (רשב"ם פרק מי שמת) וי"ח בזה (טור בשם הרא"ש):
A person dangerously ill who asked that they make a kinyan for the gifts; it contains one se'if. Even though the gift of a person dangerously ill does not require a kinyan (a formal act of acquisition), if he asked that they make a kinyan from him, they make the kinyan even on the Sabbath, for this kinyan is not needed. And some say that even if there is a practical consequence in the kinyan — for example, he writes all his property and specifies that he shall not retract if he rises — they make the kinyan on the Sabbath. Hagah [Rema]: And some say that even a gift of part, which requires a kinyan — even though it appears that he does not give out of anxiety over death, since he does not (give) all of it — even so they make a kinyan from him on the Sabbath (the Rashbam, chapter "One who died"); and there are those who disagree about this (Tur in the name of the Rosh).
