Se’if 1א׳
איזה לשון מועיל לש"מ ואמר תנו מנה לפלוני ומאתים לפלוני וש' לפלוני. ובו לג סעיפים: שנים שנכנסו לבקר את החולה וצוה בפניהם כותבין ואין עושין דין ואם היו שלשה רצו כותבין רצו עושים דין: הגה להחזיק כל אחד במה שצוה ולדון בכל דברי ספק שנפל בצואה ואן אחד מן היורשין או מקבלים יכולים לומר לב"ד אחר אזלינן (טור) בד"א ביום אבל בלילה כותבין ואין עושין דין:
What language avails for a person dangerously ill, and one who said: give a maneh to so-and-so and two hundred to so-and-so and three hundred to so-and-so; it contains thirty-three se'ifim. Two who went in to visit the sick man, and he gave instructions before them — they write, but they do not execute judgment; and if they were three — if they wish they write, if they wish they execute judgment. Hagah [Rema]: To put each one in possession of what he commanded, and to judge every matter of doubt that arose in the will; and none of the heirs or recipients can say: let us go to another court (Tur). In what case are these words said? By day; but at night they write and do not execute judgment.

ש"מ שצוה ואמר יטול פלוני כל נכסי או מקצת נכסי או יחזיק או יזכה או יקנה כולם לשון מתנה הם וכן אם אמר יחסון או יירש על מי שראוי ליורשו ה"ז קנה אבל אם אמר יהנה פלוני בנכסי או יעמוד בהם או יראה או ישען בהם לא קנה ואם אמר אני מניח לפלוני הוי לשון מתנה ואם אמר לשון יפול לפלוני כך וכך לשון ירושה הוא: הגה ובכל זה דוקא שהזכיר לשון מתנה אבל אם אמר כך וכך לפלוני בנכסי לאו כלום הוא (מהרי"ק שורש צ"ד) האומר לפרוע לאשתו כתובתה במעות מזומנים אין זה לשון מתנ' ואין יורשין צריכין לקיי' משו' מצו' לקיים דברי המת (ב"י סי' רנ"ב בשם הריטב"א) כמו שנתבאר סוף סי' רנ"ב:
A person dangerously ill who gave instructions and said: let so-and-so take all my property, or part of my property; or: let him take possession, or: let him acquire, or: let him obtain — all of them are expressions of gift. And likewise if he said: let him possess, or: let him inherit, of one who is fit to inherit from him — this one has acquired. But if he said: let so-and-so benefit from my property, or: stand in it, or: see it, or: lean upon it — he has not acquired. And if he said: I leave to so-and-so — it is an expression of gift; and if he said the expression: such-and-such shall fall to so-and-so — it is an expression of inheritance. Hagah [Rema]: And in all this, specifically where he mentioned an expression of gift; but if he said: such-and-such to so-and-so of my property — it is nothing (Maharik, shoresh 94). One who says to pay his wife her ketubah in ready money — this is not an expression of gift, and the heirs need not fulfil it on account of the mitzvah to fulfil the words of the dead (Beit Yosef, siman 252, in the name of the Ritva), as was explained at the end of siman 252.
