מתנת שכיב מרע מוציאין ממנו למזון האשה והבנות. ובו ב סעיפים: מתנת שכיב מרע אינה קונה אלא לאחר מיתה ואין אחר זוכה בדבר שצוה לו בין במקרקעי בין במטלטלי אלא לאחר מיתה לפיכך מוציאין אפי' לכתובת בנין דכרין ולמזון האשה והבנות מיד אלו שצוה לתת להם שהרי במיתתו נתחייבו הנכסים בכתובה ובמזונות ואלו שנתן להם לא יקנו אלא לאחר מיתה: הגה ודוקא שאין נכסים גבי יורשיו (נ"י ס"פ י"נ) ואחד שנתן במתנת ש"מ ושמעה אשתו ולא מיחתה ואח"כ חזר ונתן ואז מיחתה אשתו אין גובאת כתובתה ממתנה זו שהרי המתנה הראשונה קיימת ולא אמרינן דשנייה בטלה הראשונה דהרי לא חזר בראשונה רק בא להחזיקה (מרדכי ריש אלמנה ניזונית ופ' מי שמת) וי"א דאע"פ ששתקה בשעת המתנה גובאת כתובתה ממתנתו (מרדכי שם ומהרא"י בפסקיו סי' פ"ו) ועיין בא"ע סי' ק':

The gift of a person dangerously ill — they take from it for the maintenance of the wife and the daughters; it contains two se'ifim. The gift of a person dangerously ill acquires only after death, and the other does not acquire the thing that he commanded for him, whether in land or in movables, except after death. Therefore they take even for the ketubah of male children (by which a wife's sons inherit her ketubah), and for the maintenance of the wife and the daughters, from the hand of those to whom he commanded to give; for at his death the property became liable for the ketubah and for the maintenance, and those to whom he gave will acquire only after death. Hagah [Rema]: And that is specifically where there is no property with his heirs (Nimukei Yosef, end of chapter "There are those who inherit"). And one who gave as the gift of a person dangerously ill, and his wife heard and did not protest, and afterwards he went back and gave it, and then his wife protested — she does not collect her ketubah from this gift, for the first gift stands, and we do not say that the second cancelled the first, for he did not retract from the first but came to strengthen it (Mordechai, beginning of chapter "A widow is maintained", and chapter "One who died"). And some say that even though she was silent at the time of the gift, she collects her ketubah from his gift (Mordechai there, and Maharai in his rulings, siman 86). Se’if 2ב׳

מצוה לקיים דברי המת אפי' בריא שצוה ומת והוא שנותנו עכשיו לשליש לשם כך: הגה אבל היו בידו קודם ולא לשם כך או שבאו לידו אחר הצוואה אין בזה משום מצוה לקיים דברי המת (טור ומרדכי פרק מי שמת) כל דבר שנקנה במתנת שכיב מרע אם קדמו היורשין ומכרו המקבל יכול להוציאו מן הלוקח אבל דבר שלא ניתן במתנה רק שמצוה לקיים דברי המת אם קדמו היורשין ומכרו מה שעשו עשו (הגהות מרדכי דב"ב מי שנשבע או נדר ליתן לפלוני כך וכך ומת ולא נתן יורשיו פטורין ואין בזה משום מצוה לקיים דברי המת (ב"י בשם ריטב"א) ועיין לעיל סוף סי' רי"ב סעיף ז' (ובסימן ר"ט ס"ד) מי שהפקיד מעות אצל חבירו ואומר שאם ימות יעשה בהן המוטב יתנו ליורשיו (ב"י סי' רנ"ג בשם מרדכי פרק מי שמת) (וכ"כ לקמן סי' רפ"ב ס"א):

It is a mitzvah to fulfil the words of the dead, even a healthy person who gave instructions and died, provided that he gives it now to a third party for this purpose. Hagah [Rema]: But if it was in his hand before, and not for this purpose, or it came into his hand after the will, there is no consideration here of the mitzvah to fulfil the words of the dead (Tur, and Mordechai, chapter "One who died"). Anything that is acquired by the gift of a person dangerously ill — if the heirs came first and sold it, the recipient can take it out of the buyer's hand; but a thing that was not given as a gift, only that it is a mitzvah to fulfil the words of the dead — if the heirs came first and sold it, what they did they did (Hagahot Mordechai on Bava Batra). One who swore or vowed to give so-and-so such-and-such, and died and did not give — his heirs are exempt, and there is no consideration here of the mitzvah to fulfil the words of the dead (Beit Yosef in the name of the Ritva). And see above, end of siman 212, se'if 7 (and in siman 209, se'if 4). One who deposited money with his fellow and says that if he dies he should do with it what is best — they give it to his heirs (Beit Yosef, siman 253, in the name of Mordechai, chapter "One who died") (and so it is written below, siman 282, se'if 1).
