Se’if 1א׳

דיני מתנת שכיב מרע או בריא. ובו ב סעיפים: הנותן מתנה כשהוא ש"מ וכתב בה בחיים ובמות או מחיים ובמות בין בכל בין במקצת הואיל וכתוב בה ובמות ה"ז מתנת שכיב מרע שזה שכתוב בה ובמות שלא יקנה אלא לאחר מיתה וזה שכתוב בה מחיים סימן ליישב את דעתו שיחיה מחולי זה אבל בריא שנתן מתנה וכתב בשטר מחיים ובמות הרי זה מתנה גמורה מחיים וזה שכתב בה ובמות כמי שאומר מעתה ועד עולם וכמו נויי השטר הוא זה:

The laws of the gift of a person dangerously ill or of a healthy person; it contains two se'ifim. One who gives a gift when he is a person dangerously ill, and wrote in it 'in life and in death', or 'from life and in death', whether of all or of part — since 'and in death' is written in it, this is the gift of a person dangerously ill: for this, that 'and in death' is written in it, means that he shall acquire only after death; and this, that 'from life' is written in it, is a sign to settle his mind, that he will live through this illness. But a healthy person who gave a gift and wrote in the document 'from life and in death' — this is a complete gift from life; and this, that he wrote in it 'and in death', is as one who says 'from now and for ever', and this is as the embellishment of the document.

מתנת ש"מ שאין כתוב בה שמתוך החולי הזה שצוה בו מת ואין העדים מצויים לשאול להם: הגה ויכולין העדים לסמוך על עצמו או על משמשיו האומרים שהכביד עליו החולי ונפטר (שמתוך כך) יכולים העדים להעיד כך (נ"י) אע"פ שהרי זה המצוה מת הרי המתנה בטלה שאין מיתתו ראיה שמא מחולי שנתן בו המתנה נתרפא ואח"כ חלה חולי אחר ומת לפיכך הנכסים בחזקת היורשים עד שיביא ראיה שמתוך החולי הזה שנתן בו מתנה זו מת: הגה ואם תפס המקבל למטלטלין מתוך שיכול לומר שלי הן נאמן לומר שמחולי הראשון נפטר וכן הדין אם עמד החולה ורוצה לחזור במתנתו ואומר שמתנת שכ"מ היה והמקבל אומר שבריא היה ולא יוכל לחזור על המקבל להביא ראיה (טור) וכן בכל מקום שהוא פלוגתא דרבוותא אם זכה המקבל עליו להביא ראיה (מהרי"ק שורש צ"ד ומהר"ם פדוואה סי' צ"ב) :

The gift of a person dangerously ill in which it is not written that he died of this illness in which he gave instructions, and the witnesses are not available to ask them — Hagah [Rema]: And the witnesses may rely on the sick man himself, or on his attendants, who say that the illness grew heavy upon him and he passed away (of it); the witnesses may testify so (Nimukei Yosef) — even though this one who gave instructions has died, the gift is void; for his death is no proof, lest he was healed of the illness in which he gave the gift, and afterwards fell sick with another illness and died. Therefore the property is in the presumptive possession of the heirs until he brings proof that he died of this illness in which he gave this gift. Hagah [Rema]: And if the recipient seized movables, since he can say 'they are mine', he is believed to say that he passed away of the first illness. And likewise the law if the sick man rose and wishes to retract his gift, and says that it was the gift of a person dangerously ill, and the recipient says that he was healthy and he cannot retract — the recipient must bring proof (Tur). And likewise wherever it is a dispute among the great authorities whether the recipient has acquired, he must bring proof (Maharik, shoresh 94, and Maharam Padua, siman 92).
