דין מתנת שכיב מרע במקצת או בכולה בלא קנין ובקנין. ובו כו סעיפים: מתנת שכיב מרע א"צ להקנותה בשום א' מדרכי ההקנאה שדברי ש"מ ככתובים וכמסורים דמי: הגה ואין חילוק בין צוה לתת מיד לאחר מותו או שצוה ליורשיו ליתן לאחר זמן (נ"י פ"י וב"י סי' רמ"ח בשם הריטב"א) ואם לא צוה לתת דבר רק מינה אפוטרופסים ונתן להם רשות לחלוק נכסיו כפי מה שירצו ועשייתם יהיה כעשייתו י"א דאין בדבריו כלום דמיד שמת נפלו נכסיו קמי יורשיו ונתבטלה מתנתו (מרדכי ס"פ יש נוחלין בשם ר"ג ותשובת רשב"א סי' תש"ד) (וי"א דדבריו קיימין) (מרדכי שם בשם רשב"ם ותשובת רד"ך בית ל'):

The law of the gift of a person dangerously ill, of part or of all, without a kinyan (a formal act of acquisition) and with a kinyan; it contains twenty-six se'ifim. The gift of a person dangerously ill need not be conveyed by any one of the ways of conveyance, for the words of a person dangerously ill are as written and delivered. Hagah [Rema]: And there is no distinction whether he commanded to give at once after his death or commanded his heirs to give after some time (Nimukei Yosef, chapter 10, and Beit Yosef, siman 248, in the name of the Ritva). And if he did not command to give anything, but only appointed guardians and gave them permission to divide his property as they wish, and their doing should be as his doing — some say that there is nothing in his words, for as soon as he died his property fell before his heirs and his gift is void (Mordechai, end of chapter "There are those who inherit", in the name of Rabbeinu Gershom, and a responsum of the Rashba, siman 704) (and some say that his words stand) (Mordechai there, in the name of the Rashbam, and a responsum of Radach, bayit 30).

שכיב מרע שכתב כל נכסיו לאחרים ולא שייר כלום אע"פ שקנו מידו אם עמד ונתרפא לגמרי המתנה בטלה ממילא (ואפי' התנה בשעת המתנה שלא יוכל לחזור בו אם עמד חוזר אא"כ קנו מידו) (תשובת רשב"א סי' תתקע"ה ותשובת רמב"ן סי' ג' וריב"ש סי' ר"ז) ואם לא נתרפא לגמרי אלא ניתק מחולי לחולי אם לא עמד ולא הלך ונשען על מקלו בשוק מתנתו מתנה (אע"פ שהלך בביתו על משענתו) (מרדכי פרק אלמנה ופרק מי שמת) ואם עמד בין החולי שצוה בו ובין החולי שמת ממנו והלך ונשען על מקלו אומדין אותו על פי רופאים אם מחמת חולי הראשון מת מתנתו קיימת ואם לאו אינה מתנה ואם הלך בשוק בלא משענת אינו צריך אומד אלא בטלו מתנותיו הראשונות:

A person dangerously ill who wrote all his property to others and reserved nothing — even though they made a kinyan from him, if he rose and was fully healed, the gift is void of itself (and even if he stipulated at the time of the gift that he should not be able to retract, if he rose he retracts, unless they made a kinyan from him) (a responsum of the Rashba, siman 975, and a responsum of the Ramban, siman 3, and Rivash, siman 207). And if he was not fully healed, but passed from illness to illness — if he did not rise and walk leaning on his staff in the market, his gift is a gift (even though he walked in his house upon his support) (Mordechai, chapter "A widow" and chapter "One who died"). And if, between the illness in which he gave instructions and the illness of which he died, he rose and walked leaning on his staff, they assess him according to physicians: if he died on account of the first illness, his gift stands, and if not, it is no gift. And if he walked in the market without a support, he does not need assessment, but his first gifts are void.

בד"א בנותן מתנה אבל אם הודה על נכסיו שהם של פלוני קנה הלה ואפי' יעמוד זה א"י לחזור בו: הגה אמר רוצה אני שיהיו מטלטלין לשמעון הרי זה לשון מתנה אבל אם אמר מטלטלין אלו לשמעון או יש לשמעון בידי הוי לשון הודאה (ב"י סי' רנ"ב בשם הרשב"א) ואם הקדיש כל נכסיו ולא שייר כלום או הפקירם או חלקם לעניים אם עמד נתבטל הכל כדין נותן מתנה (ואפי' אם תפסו עניים מפקינן מנייהו (ריב"ש סי' ק"ס) ודלא כדברי החולקין וכן דין הקדש כדין מתנה שיוכל לחזור בו כמו במתנה) (טור) אם מכר נכסיו כשהיה שכיב מרע אם מקצתם מכר ממכרו קיים כבריא ואם כלם מכר אם המעות עצמם קיימים אם עמד חוזר ואם הוציא המעות אינו יכול לחזור בו:

In what case are these words said? With one who gives a gift. But if he admitted concerning his property that it is so-and-so's, the other has acquired, and even if this one rises he cannot retract. Hagah [Rema]: If he said: I wish the movables to be Shimon's — this is an expression of gift; but if he said: these movables are Shimon's, or: Shimon has them in my hand — it is an expression of admission (Beit Yosef, siman 252, in the name of the Rashba). And if he consecrated all his property and reserved nothing, or declared it ownerless, or divided it among the poor — if he rose, all is void, as the law of one who gives a gift (and even if the poor seized it, we take it out of their hand) (Rivash, siman 160) (not as the words of those who disagree; and likewise the law of consecration is as the law of a gift, that he can retract it as with a gift) (Tur). If he sold his property when he was a person dangerously ill: if he sold part of it, his sale stands as a healthy person's; and if he sold all of it — if the money itself is extant, if he rose he retracts; and if he has spent the money, he cannot retract.
