Se’if 1א׳
הנותן מתנה לחבירו ואמר ליה ואחריך לפלוני. ובו יג סעיפים: שכיב מרע שאמר נכסי לפלוני ואחריו לפלוני אין לשני אלא מה ששייר ראשון ואם היה הראשון ראוי ליורשו כגון שהיה בן מכלל הבנים אין לשני כלום (ואפי' אם גם השני ראוי לירש (המגיד פרק י"ב דזכיה וב"י בשם הר"ן) וכן אפילו הקדישה אחריו של ראשון אין להקדש כלום (תשו' רשב"א סי' תש"ד וב"י בשם גאונים) שכל לשון מתנה ליורש הרי הוא כלשון ירושה וירושה אין לה הפסק ואע"פ שיאמר ואחריו לפלוני: הגה ואם עשה הצואה במקום שנהגו לדון בערכאות של עכו"ם ובאו אח"כ (למקום אחר) לדון בדיני ישראל לא אמרינן דירושה אין לה הפסק (ריב"ש סי' נ"ב) אבל הבריא שנתן מתנת בריא על דרך זה וכתב ליה נכסי לך ואחריך לפלוני אין לשני אלא מה ששייר ראשון אפי' היה הראשון ראוי ליורשו:
One who gives a gift to his fellow and said to him: and after you, to so-and-so; it contains thirteen se'ifim. A person dangerously ill who said: my property to so-and-so, and after him to so-and-so — the second has only what the first leaves over. And if the first was fit to inherit from him — for example, he was a son among the sons — the second has nothing (and even if the second too is fit to inherit) (the Maggid, chapter 12 of the Laws of Acquisition, and Beit Yosef in the name of the Ran) (and likewise even if he consecrated it for after the first, the sanctuary has nothing) (a responsum of the Rashba, siman 704, and Beit Yosef in the name of the Geonim); for any expression of gift to an heir is as an expression of inheritance, and inheritance has no cessation, even though he says: and after him, to so-and-so. Hagah [Rema]: And if he made the will in a place where they are accustomed to be judged in the courts of the gentiles, and they came afterwards (to another place) to be judged by the laws of Israel, we do not say that inheritance has no cessation (Rivash, siman 52). But the healthy person who gave a healthy person's gift in this manner, and wrote to him: my property to you, and after you to so-and-so — the second has only what the first leaves over, even if the first was fit to inherit from him.
Se’if 2ב׳
שכיב מרע שאמר נכסי לך ואחריך לפלוני והיה הראשון ראוי ליורשו ופי' ואמר לא משום ירושה אני נותן לך שאין לה הפסק אלא במתנה והרי הפסקתיה השני קונה מה ששייר ראשון לפיכך אם נתן המעות ע"י שליש ואמר תנו לבני שקל בכל שבת ולא משום ירושה אני נותנה להם והנשאר מהנכסים אחר מותם יהיה לפלוני אין נותנים להם אלא שקל אע"פ שאינו מספיק להם (וע"ל סי' רנ"ג סעיף ו'):
A person dangerously ill who said: my property to you, and after you to so-and-so, and the first was fit to inherit from him, and he specified and said: I do not give it to you as an inheritance, which has no cessation, but as a gift, and behold, I have made it cease — the second acquires what the first leaves over. Therefore, if he placed the money in the hand of a third party and said: give my sons a shekel every week, and I do not give it to them as an inheritance, and what remains of the property after their death shall be so-and-so's — they give them only a shekel, even though it does not suffice them (and see below, siman 253, se'if 6).

נכסי לפלוני ואחריו לפ' ואחריו לפלוני מת ראשון קנה ב' מת ב' קנה ג' מת שני בחיי ראשון הנכסים של יורשי ראשון וכן דין שלישי עם השני (המגיד הנ"ל) אע"פ שאמרנו אין לשני אלא מה ששייר ראשון אסור לראשון למכור או ליתן גופו אלא אוכל הפירות עד שימות ויזכה השני ואם עבר הא' ומכר או נתן במתנה אין השני מוציא מיד הלקוחות שאין לשני לא מהגוף ולא מהפירות אלא הנשאר וכל המשיא עצה לראשון למכור נקרא רשע ואפי' היו בהם עבדים והוציאם הראשון לחירות או כלים ועשאם תכריכים למת מעשיו קיימים: הגה נתן לראשון הנכסים לעשר שנים ואח"כ לפלוני ומכרן הראשון השני מוציא מיד הלקוחות שהרי לא נתן לו מתנה גמורה רק לזמן (טור):
My property to so-and-so, and after him to so-and-so, and after him to so-and-so: if the first died, the second acquired; if the second died, the third acquired. If the second died in the lifetime of the first, the property belongs to the first's heirs; and likewise the law of the third with the second (the Maggid, as above). Even though we have said that the second has only what the first leaves over, the first is forbidden to sell or to give the body of it, but he eats the produce until he dies and the second acquires. And if the first transgressed and sold it or gave it as a gift, the second does not take it out of the hand of the purchasers, for the second has neither the body nor the produce, but only what remains. And whoever advises the first to sell is called wicked. And even if there were slaves among them and the first set them free, or articles and he made them shrouds for the dead, his acts stand. Hagah [Rema]: If he gave the first the property for ten years and afterwards to so-and-so, and the first sold them, the second takes them out of the hand of the purchasers, for he did not give him a complete gift, but only for a time (Tur).
