Se’if 1א׳
השולח חפצים לבני ביתו ולא פירש היאך יחלקום. ובו ה סעיפים: בריא ששלח כלים ממדינת הים ואמר ינתנו אלו לבני הרי אלו ינתנו לבנים ולבנות הראוי לבנים כגון ספרים וכלי מלחמה לבנים והראוי לבנות כגון כלי משי הצבועים וחלי זהב יטלום הבנות היו ראויים לזכרים ולנקבות יטלו אותם הזכרים: הגה מי שהיו לו בנים מאשה אחת ונשא אשה אחרת והתנה עם בניו הראשונים שבניו עם השניה יטלו חלק בירושה כמו הם ולא היה לו מן השניה רק בנות אין לבת במקום הבנים כלום (מרדכי ר"פ מי שמת) :
One who sends articles to the members of his household and did not specify how they are to divide them; it contains five se'ifim. A healthy person who sent articles from a country overseas and said: let these be given to my sons — these are given to the sons and to the daughters: what is fit for sons, such as books and weapons, to the sons; and what is fit for daughters, such as dyed silk garments and ornaments of gold, the daughters take. If they were fit for males and for females, the males take them. Hagah [Rema]: One who had sons from one wife, and married another wife, and stipulated with his first sons that his sons by the second should take a share in the inheritance as they do, and he had from the second only daughters — the daughter has nothing where there are sons (Mordechai, beginning of chapter "One who died").

וכן המשלח כלים לביתו סתם והיו בהם כלים הראויים לבנות יטלו אותם בנותיו אומדן דעת הוא שלהן שלח ואם אין לו בנות או שהיו בנותיו נשואות יטלו אותם נשי בניו שהדעת נוטה שלהם שלח ויש מי שאומר דה"מ דלית ליה איתתא אבל אי אית ליה איתתא ודאי לדידה שדר דכגופו דמיא:
And likewise one who sends articles to his house without specification, and among them there were articles fit for daughters — his daughters take them; it is an estimate of his mind that he sent them for them. And if he has no daughters, or his daughters were married, his sons' wives take them, for the mind inclines that he sent them for them. And there is one who says that these words are where he has no wife; but if he has a wife, he certainly sent them for her, for she is as his own body.

שכיב מרע שאמר נכסי לבני בלשון רבים ולא היה לו אלא בן אחד ובנות הכל לבן לבדו (וכ"ש אם יש לו בנים רבים דהכל לבנים) ואין הבנות בכלל (ואם אמר בפי' לבני ולבנותי הראוי לבנים לבנים והראוי לבנות לבנות) (מרדכי פרק מי שמת) וכן אין בן הבן בכללן (ומעשה באחד שציוה כל אשר לו לבנו רק שיתן סך מה לכל אחת מבנותיו ומתה א' מהן בחייו והניחה בן אין לבן בתו כלום דלה ולא ליורשיה קאמר ועוד דבן בתו לא מקרי בן) (מרדכי פ' מי שאחזו) יש מי שאומר דאי לית ברא אלא בר ברא ודאי אבר ברא קאמר: הגה אפי' אם יש לו בנות (נ"י פ' מי שמת בשם הריטב"א ) מיהו אם אמר ליתמי הבנות בכלל כנ"ל מתשובות הרא"ש (כלל פ"ה ס"ג) וה"ה אם אמר ליוצאי חלציו (מהרי"ו בפסקיו):
A person dangerously ill who said: my property to my sons, in the plural, and he had only one son and daughters — all is for the son alone (and all the more so if he has many sons, that all is for the sons), and the daughters are not included (and if he said explicitly: to my sons and to my daughters, what is fit for sons goes to the sons and what is fit for daughters to the daughters) (Mordechai, chapter "One who died"). And likewise the son's son is not included among them (and it once happened that one commanded all that he had to his son, only that he should give a certain sum to each one of his daughters, and one of them died in his lifetime and left a son — his daughter's son has nothing, for he meant to her and not to her heirs; and further, a daughter's son is not called a son) (Mordechai, chapter "One who was seized"). There is one who says that if there is no son but only a son's son, he certainly meant the son's son. Hagah [Rema]: Even if he has daughters (Nimukei Yosef, chapter "One who died", in the name of the Ritva). However, if he said 'to my orphans', the daughters are included, so it seems to me from the responsa of the Rosh (klal 85, siman 3); and the same law applies if he said 'to the issue of my loins' (Maharyu in his rulings).
