Se’if 1א׳
השומע שמת בנו וכתב נכסיו לאחר. ובו יז סעיפים: לעולם אומדי' דעת הנותן אם היו הדברי' מראין סוף דעתו עושים ע"פ האומר אע"פ שלא פירש כיצד מי שהלך בנו למדינת הים ושמע שמת וכתב כל נכסיו לאחר מתנה גלויה גמורה ואח"כ בא בנו אין מתנתו קיימת שהדברים מוכיחים שאלו ידע שבנו קיים לא היה נותן כל נכסיו לפיכך אם שייר מנכסיו כל שהוא בין קרקע בין מטלטלין מתנתו קיימת:
One who heard that his son had died and wrote his property to another; it contains seventeen se'ifim. One always estimates the giver's mind: if the matters show his ultimate intention, they act according to the estimate, even though he did not specify. How? One whose son went to a country overseas, and he heard that he had died, and he wrote all his property to another as an open and complete gift, and afterwards his son came — his gift does not stand, for the matters show that had he known that his son was alive he would not have given all his property. Therefore, if he reserved anything at all of his property, whether land or movables, his gift stands.
Se’if 2ב׳
יש מי שאומר שדין זה דוקא בשכיב מרע אבל לא בבריא ויש מי שאומר דאפי' בברי' היא:
There is one who says that this law is specifically with a person dangerously ill, but not with a healthy person; and there is one who says that it applies even with a healthy person.
Se’if 3ג׳
יש מי שאומר דה"ה בריא שכתב כל נכסיו לאחר מחמת שהיה צריך לברוח מפני בעלי חוביו או מפני אויביו ואח"כ עשה פשרה עם בעלי חוביו ואויביו או שמתו אם נתברר שלא כתב מתנה זו אלא מחמת כן הואיל ונדחית השעה מפניו והרי הוא צריך לנכסיו בטלה המתנה:
There is one who says that the same law applies to a healthy person who wrote all his property to another because he had to flee from his creditors or from his enemies, and afterwards he made a compromise with his creditors and his enemies, or they died: if it has been made clear that he wrote this gift only on this account, since the danger of the hour has passed from him and he needs his property, the gift is void.
